Supreme Court orders Trump’s ‘Remain in Mexico’ policy reinstated

The application for a stay presented to Justice Alito and
by him referred to the Court is denied. The applicants have
failed to show a likelihood of success on the claim that the
memorandum rescinding the Migrant Protection Protocols was not
arbitrary and capricious. See Department of Homeland Security v.
Regents of Univ. of Cal., 591 U. S. ___ (2020) (slip op., at 912,
17-26). Our order denying the Government’s request for a stay
of the District Court injunction should not be read as affecting
the construction of that injunction by the Court of Appeals.
Justice Breyer, Justice Sotomayor, and Justice Kagan would grant the application.
 
Finally, a little bit of sanity into this crazy last week! This is very good news.

Reuters is claiming the Judges' referenced Trump not being able to end the Obama's DACA order, when basing their decision. Looks like, ''what-comes-around-goes-around.

But all this means is Biden, like Trump, can end a former-President's E.O. He just has to do it properly.

We'll have to see if Biden does take the effort to properly end the E.O. I hope he doesn't, as I unusually was in agreement with Trump here.

Interestingly, Reuters is claiming the Judges' referenced Trump not being able to end the Obama's DACA order, when basing their decision.

The court's decision referenced its 2020 ruling that thwarted Trump's bid to end a program introduced by Democratic former President Barack Obama that protects from deportation hundreds of thousands of immigrants - often called “Dreamers” - who entered the United States illegally as children.

Both cases concern whether the government followed the correct legal process in unwinding a previous administration's policy.

 
This should be cause to return those who were already allowed into the country instead of waiting in Mexico.
 
If the Biden administration defiantly chooses to ignore the order, curtains for them in the next two elections; midterms/presidential.
Appearance is that the dems won't care until their targeted number of illegals is safely imbedded here.

To be clear, I haven't chased the decision down. I'd assume at the start the issue had something to do with the APA (Administrative Procedure Act). If the court referenced the DACA stuff, it's pretty much certain.

Biden should take the win, like Trump did on DACA and just drop it. Overturning this will cause more harm than good. He can run around crying about how unfair the Supreme Court is and how he should have unique standards not given to his predecessor. Radical Democrats can even use this for fundraising in upcoming elections and use this as a catalyst to dress in white and fake cry next to an open gate again.

It affirms the lower court's ruling. The irony here is the liberal justices on the court not following their own precedent.

Excellent point! We'll see if he listens or not. If he's smart, he will because his poll numbers on the border are not good! He'll lose even more political ground than he has already has recently (due to his horrible handling of Afghanistan), if he ignores this SCOTUS decision.

At this point, I don't think he give a flying **** about his poll numbers. Even if he lasts another three years (I've predicted he won't see his second year) no way in hell would he run again.
