Supreme Court formally asked to overturn landmark same-sex marriage ruling​


Ten years after the Supreme Court extended marriage rights to same-sex couples nationwide, the justices this fall will consider for the first time whether to take up a case that explicitly asks them to overturn that decision.

Kim Davis, the former Kentucky county clerk who was jailed for six days in 2015 after refusing to issue marriage licenses to a gay couple on religious grounds, is appealing a $100,000 jury verdict for emotional damages plus $260,000 for attorneys fees.

In a petition for writ of certiorari filed last month, Davis argues First Amendment protection for free exercise of religion immunizes her from personal liability for the denial of marriage licenses.

More fundamentally, she claims the high court's decision in Obergefell v Hodges -- extending marriage rights for same-sex couples under the 14th Amendment's due process protections -- was "egregiously wrong."

"The mistake must be corrected," wrote Davis' attorney Mathew Staver in the petition. He calls Justice Anthony Kennedy's majority opinion in Obergefell "legal fiction."

Now the reich-wing is going after gay marriage. This was bound to happen.

If they SCOTUS goes anywhere near this decision, there will be nuclear fallout in 2026, 2028 and beyonds.

Given the makeup of the current Court, this was bound to become an issue. Leave it to religion to argue against people's rights. They do it against abortion and they do it against marriage.

All of them need to be removed from the court and disbarred.

Sorry, that's pure hyperbole. We've heard that line many times before and it never materializes. The majority of the offline populace are simply too politically apathetic to notice.

The supreme court can and will hobble this decision.



It would be a wholly different story if the Democratic party could get their act together and produce a coherent message. "Because Trump" is obviously not a winner.

I agree with most of this except the last line. He’s potus. He’s what they’re running against. He’s super unpopular. Dems didn’t win in 2024 because they didn’t fight him, they tried to make republicans feel better about being traitors and lowlives.

If they overturned Roe they can overturn Obergefell.

When they overturned Roe, Thomas specifically cited Obergefell as the next on the chopping block.

They also want to overturn Lawrence v Texas so states can imprison gay people and Griswald v Connecticut so states can ban contraception.
 
Yep. Thomas cited a number of SCOTUS based on the 14th Amendment when overturning Roe, but weirdly left off Loving v Virginia from the list.
