Supreme Court allows Trump birthright citizenship order to continue - for now

Yeah, sure"originalists". They're going against the plain language of the constitution to serve Trumps right wing agenda.

It doesn't disallow "judge shopping", the GOP running to their favorite Texas, Mississippi, Louisiana, etc. judge or the DEMs running Maryland, Massachusetts, Washington, etc. will still happen.

The cases will still be filed in the preferred Federal District, and the filings will now request Class Action Status as Justices Kavanaugh and Sotomayor suggested in Friday's SCOTUS order.

The first filing in regards to Birthright Citizenship and requesting a new injunction under Class Action certification occurred within a couple of hours.

Partially incorrect. It's presented as a binary statement. As "either/or" if you will. It's more of yes, no, sometimes situation.

I'm saying that with Class Action certification that a Judge in any federal district can issue a nationwide injunction. So in Class Action cases a "red state district" CAN issue an injunction in a "blue state district".

Class Action certification motion was filed within 2 hours of the SCOTUS issuing the decision.

You might have a ban on future sales, but good luck confiscating 350 million or so firearms. A lot of boating accidents are likely to occur and they get lost at sea.

Only real way to ban firearms is to repeal the 2A. Good luck.

It's not about "could Harris seize every firearm in the US?" It's that this ruling makes it extremely difficult to stop the President -- ANY President -- from issuing and immediately executing unconstitutional edicts, and doing lots of damage before anyone can possibly stop it.

Having had a chance to digest this more, it strikes me just how bad this ruling is absent any discussion of birthright citizenship.

The end result of this is almost certainly more chaos in the Courts for the minor relief of limitations on universal injunction and grants certain entities, especially the Federal government, explicitly more power with regards to legal actions with an inherent ability to simply shift their operations to another, potentially more friendly, circuit.

So how does anyone stop any of the three branches if they go rogue and don’t care about following the Constitution? Considering the Judicial branch allowed it, it still can initially be stopped by a class action lawsuit.

The Constitution preventing the government from removing rights is supposed to be difficult to change. The correct way would be writing an amendment repealing the 2A, not by writing an illegal EO that is already stopped by the 2A.

US citizenship, the judge added, “is the greatest privilege that exists in the world.”
