Should the government be required to pay lawyers' fees if they lose?

Trump is now using his DOJ to punish those who he feels are his enemies. Even if they lose in court with these barely concealed punishment cases, they cost the people huge amounts in court costs without costing Trump a penny. Maybe it is time if the government pushes these punishment cases that the court determines were brought without merit, then the government should be required to pay all of the court costs of the defendants and even punish the government by adding additional money to the court cost.

Every one of these people needs to file a countersuit and they need to make sure they aim for 10 figures. Trump should be required to pay 50% of the legal costs and all of the damages.

I think you guys better think real hard here. We are talking county, municipal, and state criminal and civil and tax courts as well as federal courts.

We can't even seem to fund Legal Aide sufficient to get effective council and investigatory hours, maybe fly in an expert witness when destitute people charged with capital crimes. We have people on death row, who could not get a forensic expert's travel expenses re-imbursed.

Imagine what this does to the budgets of your local DA's office, and what it does to their decision-making metrics.

And it gives the govt a huge advantage. Their "pockets" are bottomless. They can 'fight' forever using our tax $$$.

And that also gives them leverage...the opposite side knows this, that they can be dragged thru the courts for years, paying thru the nose.
