The TENTH (civil war) amendment has ALWAYS been the problem.It will be interesting to see how this plays out. As written, it may pass. I'll bet the amendment process could kill it though.
It repeals Section 1738C of title 28 and directs all states, territories, etc. to recognize same sex marriages. This could become a tenth amendment problem.
