Seems Trump's legal team may regret their choice for Special Master

Apparently, Trump's legal team may not be pleased with their Special Master choice. He is a very well respected, experienced Judge and quite frankly I was very surprised they put him forward. In a response to questions from the Special Master, they pushed back on several things.

One I found most surprising was their comments that they did not want to comply with his request to provide information to substantiate the claim that Trump declassified the documents. They said they didn't want to disclose that because it may be required as a defence if Trump is indicted. More likely they don't want to submit untruths to the Judge but the fact they admitted an indictment was a possibility was interesting. The judge's response will be very interesting.

Even more interesting the Special Master wants to know why, if they thought the search violated Trump's 4th amendment rights, they offered no objection based on that to the Judge who authorized the search.

They also are pushing back on the fact the Judge wants to move quickly and have all the documents sorted by the end of the first week of October. They want that slowed down. there's a surprise

I think that this Special Master may prove very problematic for Trump.

Trump: it doesn't matter if the documents are classified. They have my handwritten notes on them so they're protected by executive privilege.

I found it amazing that Trump's team chose such a good judge. Almost like they were seriously concerned about 'attorney in confidence' documents which Trump should already have separated from the others.

Then I heard that the judge won't be finished until after the elections. That is right and proper: a good judge would avoid interfering with an election, even though Trump is not a candidate. Someone on the Trump team (behind the fall guys and fall gals) has a working brain. They came up with a legal and legitimate delaying tactic.
 
Using Trump's logic, if I wrote a note to my lawyer on a bag of cocaine, it would be protected by attorney/client privilege.

No seriously. If there is a brain somewhere amongst Trump's toadies, they might have told him to spike the documents with actual correspondence with his lawyers ... even after he was President.

Worst case scenario is that ALL OF IT is paid chatter between Trump and his lawyers, opinions about baseball etc. And whatever used to be in the Top Secret folders has been destroyed. Trump walks free, because destroying a document you believe to be declassified, is not even a crime ...

I completely agree. I read their letter to the Judge. That is almost certainly a loser. He's a long-standing federal District Court Judge. It's like they want to ignore everything they know he wants. That is the best way to piss off any Judge. He'll just move forward with his schedule and probably we'll have a recommendation to lift the order regarding the classified documents by the end of the week. They just employed terrible strategy.

I am going to give a smidgen of sympathy to Christopher Kise. He came late to the party and the keg was already emptied. He was shrewd to get his money up front.

It's part of their plan, and it's going well-enough for them. They're stalling (to get past the mid-terms & even '24 if they can), and will subsequently challenge & appeal every little thing. There will be many more challenges & appeals - I predict.

This is not Trump's legal defense (yet).

I don't think they're focusing on a legal defense (yet), but rather they're stalling to get past the midterms (& '24 if they can).

Dunno.........they have no ability to dictate or even appeal to the SM. He is totally in charge of how he goes about this.

This is not Trump's legal defense (yet).
Their mistake is in picking a Judge known for being efficient. But, you're right, they still have Judge Cannon to gum up the works. Unless the 11th Circuit does its job.

I agree, but because they didn't focus on their legal defense, they blew an opportunity. A shrewd judge (and Dearie is reputed to be one) will sidestep their bluster and focus on its lack of candor. Ultimately, it was a wasted opportunity, but, then, they don't really have a legal defense, so maybe it is the best they can do.
