Chicago’s 11 p.m. park curfew strikes a balance between public safety and First Amendment rights, Mayor Rahm Emanuel argued Friday, before the city filed a notice that it would appeal a court ruling overturning the arrest of 92 Occupy Chicago protesters and the curfew they were accused of violating.
The mayor added, “There will be another judge who will also be given a chance to weigh in. It doesn’t mean it’s the final word. ... We believe — based on both [U.S.] Supreme Court decisions dating back to 1984 and decisions other cities have made — that this ordinance balances both public safety and public free speech.”

Circuit Court Judge Thomas More Donnelly ruled this week that the city infringed on the First Amendment rights of hundreds of Occupy Chicago protesters who were arrested last October when they refused to leave Grant Park at its 11 p.m. closing time.
Donnelly threw out the charges against 92 of the demonstrators, saying the curfew law used against them was unconstitutional and violated their right of free assembly.

In the run-up to the NATO Summit, Emanuel and Police Supt. Garry McCarthy presented the city’s treatment of Occupy Chicago protesters as a “model” for dealing with protesters going forward.

They also presented it as a sharp contrast to the 900 Iraq War protesters arrested or detained after a 2003 demonstration that shut down Lake Shore Drive and triggered a $12 million settlement, including legal fees. Donnelly called a stunning halt to that argument, handing the mayor, yet another defeat on the First Amendment front.

Emanuel also squared off against protesters before the NATO Summit. He tried to impose strict rules and fines governing public protests before softening those rules under pressure from Chicago aldermen.....snip~

Looks like Emanuel and the Democrats will continue their onsluaght on the First Amendment. As we can see the Socialist Emanuel has no problem going after Veterans and even the Occupy movement. Even after his favorite lady that he likes to fondle and kiss came out and stood with the Occupy Movement. (Pelosi)
Do people actually think the Progressives actually care about the dregs of society?

Any reason why Emanuel should be allowed to waste the City's money in taking this into the Appellate Court. Where it will sit for a bit racking up court costs?

Do you think the next time Emanuel is out and talking about how much he cares and luvs Veterans, and that he wants to thank us so much. That we should even listen to one ounce of his BS. Shouldnt he be called out by Vets non-stop?

Shouldn't this threat to the US Constitution be dealt with? Shouldnt the People of Chicago and Illinois be doing evrything they can to Run this politician into the Ground and then send him out to pasture? Think the World of Media will keep all his defeats and abysmal record forefront with any attention?

IMO violating a curfew is not a free speech issue, it is a violation of the curfew ordnance issue. Free speech does not allow the violation of other laws.

Intreresting that Emanuel turned loose from the Obama administration is willing to take on issues like unions and the Occupy movement.

Yeah Enamuel wants the Spotlight. Wants to run for the Presidency. Want to run around and talk about what he thinks is for the betterment of all. His brother is a producer in Hollywood too. So Emanual will try and walk over who he can to get what he wants. Chicago should have been smart enough to never elect him.

Even Daley has come out criticizng Emanuel over dealing with the Teachers Union. Plus we will be hearing of when Emanuel starts to deal with the issue of pension Reform. Which both him and Quinn are going after the Unions on that one.

Well it wasnt just Daley.....It's all those Chicago Aldermann too. Where do you think the money is going to come from to help fill those coffers? Just where do you think Rahm gets the Progressive backing from?

If Daley and all the alderman, and all the union leaders are criticizing my actions, I would believe I had got it right.

I don't know enough about Rahm's brother and the Hollywood elite supposedly filling the coffers of Rham, if they are, let them spend the money on local politics. Less to spend where I live.

Yeah but then Emanuels brother already does that with the money as well as throwing it out to Obama's Campaign and Pelosi. Just to name a couple. Myself I hope more and more of the poor and destitute awake to the fact just where those 1% are within that Democratic Party.

Do you think he might have won that Mayoralship due to his relationship with Obama moreso than his identity and life to Chicago Politics? He never was really part of Chicago and it's Politics. Moreover like Obama he thinks he can spend and look to squeeze the money outta somehwere else. Excpet there is no where else to get the Money.

Again why should he waste the taxpayers money on this after the court is ruled? Can't get money out of people who have none. Moreover Emanuels said it was like comparing Apples and oranges when in comparison to the 2008 Partyfest for Obama. His excuse was they werent there to sleep on the grounds for Obama's Election. Yet they didn't expect people to stay all night at Grant Park parting either. Which they did until the next morning. Kinda hard to sleep on the ground with people Blasting music, drinking, and having a good time while walking all over one.

Every forest preserve in Cook and DuPage Counties has a closing time. What's the deal? Parks can never close, yet the city can be held liable for the safety of those inside? I completely agree with Emanuel and hope the appeal wins. Yes, they have the right to assembly. On the sidewalks. They do not have the right to take over a public park 24/7. Balance the rights of the citizens who pay for the upkeep of the parks, their safety, the safety of those who have every right to use them.

Well, I was looking at it from more of the perspective of what money he would get out of them for the fines. Especially if they are broke. As well as wasting the taxpayers money in Court. Calumet Park has a Curfew and it is in the City. Get caught going up in there just to drive thru to come out on the other end of South Chicago and watch what happens. So truly I didnt see it as most of the parks have a time when they close already in the city. Over by Hyde Park ya can park by the lake. But you better not get caught in the Park Proper after it closes.

Grant Park is completely different with the Trains over there and the way thru Over to Field Musueam and the Shedd and being off of Michigan Ave. People are cutting thru all the time.

Still Emanuel cant have it one and not the other. IF they arrested the ones down by Grant park for the Obama Party and then cut them loose. Then shouldnt the law apply to those Occupiers too?

Again they already were locked up for whatever amount of time. So how do they pay the fines if they have no jobs?

You are bringing up two points, both valid. Point one, all protests should be treated equally. If one is not allowed to camp out in the park, then none should be allowed to camp out. I'm assuming that both groups are violating curfew.

Point two. How do they pay the fines? At least as yet, fines do not operate the same as taxes, and are not assessed on an ability to pay basis. Here if you do not pay your fines, you hear about it when you renew licenses and stickers. If, as you say, these people have no jobs, and the city is short of cash, long extended community service might be in order. Let the violators clean streets, toilets, or whatever else needs to be done. If they slack off and just stand around, then back to jail they go.

I agree there which I think the judge should have ordered Community service to go and clean up their mess from the get go. No need to keep them in jail and costing us there. Both violated the Curfew IMO.....so thats why I wouldnt let Emanuel get away with that statement. But he is desperate for money for the City. Which is why he is contemplating on another tax for cigarettes. Since he did the Right thing and refused to raise taxes. Basically due to how bad it is here.

Unemploymnet rose for the 3rd month straight now and more and more buisnesses are leaving the City and the State.
