It's not black and white... the system doesn't address illegal immigration based solely on whether a person is in the country legally or not. I mean, at the borders these things matter, but the courts are not going to allow themselves to be backed up by thousands upon thousands of cases to address a never ending flow of individuals. It makes much more sense to address the ones who are committing actual crimes while in the country.
Dealing with the illegals one by one is like trying to use a bucket to drain the ocean. If we're serious about stopping the illegals from coming in, then it makes far more sense to direct our energies at the businesses who are harbouring them. But our government will not do that because business, government, and aristocratic powers are like this.
The southern border has always been a transient region even before the American-Mexican war but especially after. Border security lies in business practice, not in physically drawing an imaginary line in the sand and expecting it to matter.
Then why not have a documented foreign worker program. Better for the the workers crossing the border and better for a country regulating who comes into the country.
We already have too many foreign worker programs as it is. A much better option would be to let the traitorous scumbag employers of illegals go out of business if they can't find any LEGAL workers. After all, they are just SCUMBAG EMPLOYERS OF ILLEGALS.
The problem with your solution is that the government refuses to do it.
