Interesting court battle in MI between the Republican controlled House and the Democrat controlled senate.
The gist of it is that the democrats (house and senate) passed nine (9) bills in the previous lame-duck session, that for some reason were not sent to the Governor in a timely manner before the current session began 1/8/2025.
The current republican controlled house has decided, at least temporarily, to not send these bills to the governor.
Frankly, I don't see how the democrats have a case here. One legislature cannot bind another, and what few seem to be asking is WHY they did not send these bills to the governor immediately upon passage.
"
Detroit — A state judge will rule in the coming days on a dispute between the Republican-controlled Michigan House and Democrat-led Senate over the fate of nine bills that the last Legislature failed to send to Gov. Gretchen Whitmer before a new raft of lawmakers was sworn in on Jan. 8.
Court of Claims Judge Sima Patel on Monday heard arguments about whether the state Constitution requires House Speaker Matt Hall, R-Richland Township, to finish the work of the last Democratic-led Legislature in presenting the bills to the governor and, if so, whether there is any sort of deadline by when he must do so."
"Attorneys for the House argued the current chamber is not bound by the action or inaction of the past legislative body and, even if it were, there is no time frame by which the Legislature must present bills to the governor."
