Judge strikes down North Dakota’s ban on abortion

Some sanity coming from North Dakota today.

Romanick had canceled a trial set for August and the judge cited how North Dakota’s constitution guarantees “inalienable rights”, including “life and liberty”. The abortion statutes at issue in the case infringed “on a woman’s fundamental right to procreative autonomy, and are not narrowly tailored to promote women’s health or to protect unborn human life”, Romanick wrote in his 24-page order on the case. He added: “The law as currently drafted takes away a woman’s liberty and her right to pursue and obtain safety and happiness.”

The US Constitution carries the same protections, so the same legal reasoning should apply to all the states. No government, state or federal, should act like it owns our bodies.

Indeed. What's needed in this country is a lot of common sense. But every little bit helps too. It's good to see someone showing the proper respect women and their rights & autonomy deserve.

The judge struck down the law "as presently drafted". So do not celebrate too soon. They will redraft and try to ban abortion again.
 
Due to procedural delays, North Dakota’s abortion ban remains in effect in the state. Staffers at the Center for Reproductive Rights, which litigated the case, do not yet have a firm sense of when abortion will become fully legal again in North Dakota.

The North Dakota state government may also appeal Romanick’s ruling, while the state legislature could try to pass a different abortion ban.

More than a dozen states have banned almost all abortions. Abortion-rights supporters have fought back, however, by seeking to overturn or suspend bans in the courts and by trying to get votes on abortion rights on state ballots. Voters in several states, including GOP strongholds like Kansas and Kentucky, have voted to preserve abortion rights.
