Is 'Coffee Mate' lookin' for trouble from the Kool-aid Man?!

Caught this commercial, and the instant thought was Kool-Aid! Oh yeah!



I know there's a ratio of when it becomes infringement, and there's that 'grey area..'
I don't know.. but screams Kool-Aid to me.



Marketing:.. "What's Kool-Aid?"

Stay away from that brick wall!

An iconic, rounded, stout glass container with a handle and a 'smiley face'?
Sound like possible infringement? 'Oh yeah!'

I don't look for Coffee Mate v Kool-Aid anytime soon, but I think there is a case.

Disclosure: I drop a very small splash of Coffee Mate hazelnut in my morning coffee, but haven't drunk Kool-Aid in ~35 years.

Seems like an appeal to the subconscious to me. "Loved Kool-Aid!"

It's a smiley face on a cup. Kool Aid probably wouldn't have a case unless Mr. Cup breaks through a wall.
