If Birthright Citizenship is revoked (like crazy ass MAGA wants) how does the US determine who is a citizen. (1 Viewer)

Okay, I'm starting this thread because some of the answers are just priceless...








As I understand this is that Trump wants to deny birthright citizenship to those who are in this country illegally. I quote, “On his first day in office, President Donald Trump issued an executive order aimed at ending birthright citizenship for babies of undocumented immigrants and for people with temporary status in the U.S.”

I am curious to see how SCOTUS handles this challenge, because legal precedent's already been set and has existed for quite some time. The details on the implications and how it would work going forward will be interesting as well, though this case will focus on clamping down on birth tourism and "anchor babies", but I lean much more towards the existing legal precedent of those born here should automatically be citizens since this is the country of their birth.

I do think there's a benefit in allowing illegal migrants to stay if they have children here, in that it grounds them here and they will establish themselves because they have children in this country. They now have a vested interest in the community they're in and will work toward securing a good future for their child, who will be a member of our society.

How does your parents establish THEY are documented??

Remember, they won't take ALL of your rights away all at once. They will chip away little by little, going after the weak, the marginalized first. Like the crab in the pot, raise the temperature slowly, and before you realize it, you're cooked.
 
As I understand it the executive order only applies to people born in the US beginning Feb 19th. It does not retroactively revoke citizenship, so people like Marco Rubio would be safe.

The executive order states that these provisions are only effective for people born 30 days or more after the date of the order; it would have only applied to children born beginning February 19, 2025 had it not been blocked.

 
We cannot overstate the significance of SCOTUS premptively granting POTUS permission to commit crimes.

If Trump were to 'accidently deport' a US citizen to a foreign country, there is simply nothing that can be done. (wink, wink). The courts have no jurisdiction in foreign countries. As long as the GOP in Congress have no stomach for challenging Trump, he will do whatever he wants to whomever he wants.

If Trump were to 'accidently deport' a US citizen to a foreign country, there is simply nothing that can be done. (wink, wink). The courts have no jurisdiction in foreign countries. As long as the GOP in Congress have no stomach for challenging Trump, he will do whatever he wants to whomever he wants.

So there are two things the administration seems to be counting on, and the one I bolded is one of them, though as we're seeing in the Garcia case is not very convincing to the courts. The other area the administration is counting on is the inability of the judiciary to compel the government to act in regards to foreign policy, which is where this lot is currently using as cover. The question then becomes one of the judiciary's ability to uphold the law, which is a pretty big deal.

Looks like he's signed 137 so far in his first ~100 days. So about 1.37 per day, which at this rate will be about 365 * 4 * 1.37 = 2000 executive orders for a 4 year term. That would be more executive orders signed than every previous president combined since Reagan (including Trump's own first term). :eek:

How long this will go on is a good question, but to me this has the feel of someone running a marathon like a sprint.

Just wait until Trump deports a judge to El Salvador. Judges from coast to coast will get the message loud and clear. FAFO.
I suspect the more light this gets, the better chance of this idea of outsourcing our prisons gets binned.

There’s no problem as this applies only to illegals here in the country illegally. It doesn’t deny birthright citizenship on those who are already citizens or to immigrants who legally come to this country. I realize this is hard to understand. It doesn’t meet the partisan political motivated criteria this thread is all about. All it’s saying is if you want birthright citizenship for your children, then come to this country legally.

Although the original intent of the 14th amendment was to ensure birthright citizenship on the children of former slaves, it didn’t specify that. The wording left it open to any and all. Thus, trying to limit the any and all is probably unconstitutional. Even bestowing birth right citizenship to lawbreaking illegals.
