If a person is 'detained' by ice who is an American citizen, how long should it take ice to confirm the person is a citizen?

I've read horror stories from the right about being detained in the back of a police car...oh the horrors, for ten minutes or so before all was straightened out. So when ICE detains an American citizen, how long should it take them to fix their mistake?

Pregnant US citizen detained by Border Patrol agents: ‘We didn’t do anything wrong’​


According to a statement from a Department of Homeland Security representative, López was arrested because she was obstructing agents from accessing a car containing “two Guatemalan illegal aliens” inside.

They weren't Guatemalan illegals after all. If ICE makes a claim, does that make it true? Sounds to me like she was detained for more than ten or fifteen minutes when all they had to do was run her identification, which I'm guessing the did and still detained her with the good old she interfered bullshit. I'm sure a nine month pregnant woman posed a supreme threat to ice.

The police can detain a person for 48 hours without a charge. I am sure ICE agents have a similar constraint.

That was not the question. How long should it take law enforcement to confirm the woman is an American citizen, ten minutes tops. I wonder if she had a gold star license?

I did not read the story. Did she provide legal identification?

I expect them to hold a color card, like a big paint chip with shades, up to their face and if the person "looks white", they just get released.

If they dont, or have a great tan, their day is shot, definitely.

Maybe I missed it, but it sounds like the article didn't say how long it took, and she had to go to the hospital before they made a definitive assessement.

My guess is 1-2 hours to verify the person's identity.

If that department is grabbing lots of people, it will take longer.

That said, we know they're making mistakes and racially profiling people. That's what happens when a white supremacist is screaming at DHS to round up 3,000 people a day, with the same staffing levels as before the big rush.... and at a time when Southwest border crossings are at low levels.

What crime was she being suspected of committing?

Masked men roll up and refuse to provide proof of why they are there.... why does a citizen have to comply?

ICE agents investigate potential illegal aliens. If you are with them you show your ID when asked. No biggy. I am an old guy and I had to show my DL when buying a bottle of wine yesterday. So what?

There is a difference in buying a product and being forced by the State to identify oneself.

Buying a product is a voluntary act.

The State rolling up and demanding ID without being about to show by what legal authority they are operating under makes us subjects of the State and not free people.

It amazes me how there are those who are okay with being subjugated.

The state requires the ID not the store. It is exactly the same thing. The law is the law. The authorities ask for an ID and if you do not give them one you are then putting yourself in legal jeopardy. There are laws and there are borders.
 
The deportation laws are on the books. Just because your guy ignored the laws does not make following them a police state.
Police state apologists always point to the laws when they don't want people to look at the police statism. So, good on you for maintaining that trend?

A store demanding ID to purchase a product means that a person is there by their own free will to purchase a product. If one does not wish to show ID to purchase a product one can simply walk away from the transaction without consequence.

Compare this to agents of the State demanding ID when a crime cannot be articulated or they cannot or will not produce the legal authority by which they are demanding the ID and the consequence of this is arrest.

That is not how free people live.

When advocates of securing the border include that the Federal Government has carte blanche to harass citizens... well... I can only guess that they really like being subjugated.

Or it could be that they believe that the subjugation will not be turned on them.

The State has no choice but to subjugate the citizenry... there are LAWS!!!!
