'A severe Constitutional injustice': Oldest federal judge refuses to go away quietly after being shelved yet again, urges full DC Circuit to hear her out on suspension

Do you think there should be a mandatory retirement age for the judiciary?

There are already mandatory retirement ages in some sectors of the government, do you believe it should be the same across the government, or just select positions?

Keep in mind, I am not talking about term limits....that's a subject for another thread.

No.

I think ‘cognitive impairment’ should qualify as grounds for impeachment. Whether (or not) that requires constitutional amendment is up to the SCOTUS to decide. That way congress, based on sufficient evidence of ‘cognitive impairment’, could remove a judge or other government official deemed incapable of performing their job.

Tough issue. I had a Great Grandmother who was sharp as a tack at 100+. Most at that age are more than a little dotty. Maybe 90?

Mandatory retirement for a some jobs...

Federal Law enforcement and firefighters: 57
Airline Pilots: 65
Foreign Service officers: 65
Air Traffic Controller: 65

A mandatory retirement age for federal justices would require a Constitutional amendment which isn’t going to happen. Justices are appointed for life, the only way to remove any of them is through impeachment. Congress could remove this 98-year-old justice if it had a mind too. Would I be in favor of a mandatory retirement age for only federal justices, no. In order for me to be in favor, the mandatory retirement age would have to apply to all facets of the federal government. To all agencies, departments, elected officials. What that age would be, I don’t know. I’m not going to worry about it as it would require a Constitutional amendment which as I stated, isn’t going to happen.

For the life of me, I don't know why they have simply not certified her as disabled and appointed a new Judge. They have quietly done this many times for other judges.

And yes, I support age limits for the Presidency, Congress and Judiciary as well as for Officers of the United States. Most people should leave office at 75. Wesley Brown famously retained his Federal Judgeship until his death at age 104, but at the very least, it should be far easier to purge decrepit jurists and in all cases they should be required to leave active status and assume senior status when they become eligible for retirement/senior status, usually between 65 and 70 years of age.

At this point, they are simply stalling until she drops dead.

I do know that they dislike her contrarian jurisprudence and her many dissents.
