I predict this will be eventually struck down. However, it is a great pre-election move, will gain the President some votes, and by the time it is struck down the election will be long over. And Obama may even be out of office.

It is freedom of speech up to a certain point. As I have said, you can say anything you want, but be ready to accept the consequences.

Yes, and there are societal consequences such as you own a store, you run your mouth, and people choose to not shop there. Then there is the calling forth of government force against the free exercise of rights. Those two things are very different and the latter is not acceptable.
