Sheriff: Three armed men broke into a gun collector's home.
According to Pasco County Sheriff Chris Nocco, the homeowner was in the house alone, playing video games. That’s when he heard glass shatter towards the back of the house.
According to the sheriff, the homeowner grabbed a gun and began walking down his hallway. That’s where he saw an armed intruder dressed in dark clothing and wearing a mask. Nocco said the homeowner shot and killed the first intruder, then took out the second one, who was right behind the first.
The sheriff says that at some point, one of the three intruders managed to fire a gun.
He missed. That was a big mistake. The homeowner shot back and hit him. That’s when the homeowner’s gun jammed, so he went to grab another one.
When he did, the third intruder managed to get up and run away.
A neighbor was there waiting… with a gun.
He stopped the criminal in his tracks and held him at gunpoint outside until Pasco County deputies arrived.
The survivor is charged with robbery and for the deaths of the other two mopes under the felony homicide rule

I believe it's called "felony murder" if you are involved in a crime where someone dies you're charged with it.Charging the survivor with the deaths of the other two is just absurd. If he wasn't the one who shot them, then he shouldn't be culpable for their deaths.

If you're part of the crime, you do the time.I understand the principle, I just think that it's a ridiculous law. Unless your actions directly led to the death of someone else, you shouldn't be liable for that.
I was just giving the 30,000 ft view. Active participation is the crime also factors its, In this case all three were intent on robbery and were armed.Doesn’t mean it’s not a dumb law. There was one case where a passenger was in a car and the driver drove off from a traffic stop making it a felony, then crashed the car and killed himself getting the passenger charged with his “murder”

A well cleaned and lubricated firearm, and regular practice of Mozambique drills can prevent this....but even in the best of situations, jams can occur.
I've rarely experienced one a good tap and rack wouldn't clear, hence my question of what went so wrong he completely gave up on the weapon in his hand and went to another part of the house for a second one. (Except for my new 870 express... it clearly needs a little work.)

I suppose it depends on what firearm he was using; based upon the article, it likely was not a revolver....I have never had a revolver jam.
Where'd you get your law degree? I would guess the guy that actual shot would get the attempted murder charge.Attempted murder would be the correct charge IMO

He committed the crime of robbery, and that's what he should be charged with. He shouldn't be charged with homicide, because he didn't kill anyone.
