The Supreme Court of Texas has ordered House Democratic Caucus chair Gene Wu to file a response to the petition for writ of quo warranto no later than 5 p.m. Friday, August 8, 2025.

Abbott filed an emergency petition with the Texas Supreme Court requesting a "writ of quo warranto," which is used to determine if a person has the legal right to hold public office.

"If a small fraction of recalcitrant lawmakers choose to run out the clock today, they can do so for any, and every, Regular or Special Session, potentially bankrupting the State in an attempt to get their way," the petition said. "...The rarely used writ of quo warranto exists to solve rare problems such as this."

The governor warned Sunday that if Democrats were not present when the House reconvened Monday at 3 p.m., he would seek their removal. The Democrats remained absent Tuesday.

No. The only court with jurisdiction would be the Supreme Court, but the Texas Government Code specifically exempts the governor.

The supreme court or a justice of the supreme court may issue writs of procedendo and certiorari and all writs of quo warranto and mandamus agreeable to the principles of law regulating those writs, against a statutory county court judge, a statutory probate court judge, a district judge, a court of appeals or a justice of a court of appeals, or any officer of state government except the governor, the court of criminal appeals, or a judge of the court of criminal appeals. -- Texas Government Code - GOV'T § 22.002. A BBC article reports Trump wants to interject himself into the fray by lending out the FBI to roundup the runaway mavericks.

At a White House event on Tuesday, President Donald Trump said the FBI "may have to" help Texas authorities in locating and arresting the lawmakers.

"I know they want them back, not only the attorney general ... the governor of Texas is demanding they come back. So, a lot of people are demanding they come back," Trump said.

Weird ideology of 'democracy' the democrats have......only wanting total and absolute control, yet when out of control just walk away to obstruct any and all proceedings, either way "they" have total authority. Hell, it's not 'democracy', it's totalitarianism, one party rule.

U.S. Sen. John Cornyn urged the FBI on Tuesday to "aid in Texas state law enforcement efforts to locate or arrest" the Texas House Democrats who have fled the state to stop the GOP's redistricting effort.

"The FBI has tools to aid state law enforcement when parties cross state lines, including to avoid testifying or fleeing a scene of a crime," Cornyn said in a letter to FBI director Kash Patel. "Specifically, I am concerned that legislators who solicited or accepted funds to aid in their efforts to avoid their legislative duties may be guilty of bribery or other public corruption offenses."

Bribery allegations are likely related to soliciting donations to support the runaways' runabout.
 
Yeah, don't even bother thinking about why the Dems are doing this. Just label them as being in the wrong by default. The world is so much simpler that way. Simple thoughts lead to simple solutions.

If you honestly have sincere concerns about democracy versus totalitarianism, don't look now, but it's actually your Texas Republicans who are acting like un-democratic totalitarians, cheating the gerrymandering rules by trying to redraw district lines ahead of schedule in an obvious and corrupt attempt to rig the midterm elections.

For the Dems to walk out and refuse to allow that corrupt vote-rigging legislation to pass is excellent representation on their part. And you call them the totalitarians? What a clueless farce.

I don't doubt it. Give the devil his due, Paxton beat the federal charges after years of evasion and came out on top. We couldn't even convict the guy after impeaching him. Now he has his sights set on the senate. Thought of a Senator Paxton gives me the shivers.

Doesn't excuse our runaway Democrats. An El Paso nonscientific TV station's poll asks, Do you think absent Democrats should be removed from office? No: 38% Yes: 62% Participants 535 But who knows who clicks on online polls.
 

Yeah it kinda does because what Texas is doing is kinda wrong, and if this sort of thing were initiated in a blue state under a blue administration....
