A federal judge ruled Thursday that President Donald Trump's former personal lawyer, Alina Habba, has been unlawfully serving as the top federal prosecutor in New Jersey, declaring that her continued role as U.S. attorney after July violated federal law. The decision, handed down by U.S. District Judge Matthew Brann, a Republican, concluded that Habba's statutory term as interim U.S. attorney expired on July 26, 2025, and that subsequent efforts by the Trump administration to keep her in office without Senate confirmation did not comply with governing procedures. "I conclude that she is not statutorily eligible to perform the functions and duties of the office of the United States Attorney and has therefore unlawfully held the role since July 24, 2025," Brann wrote. Habba is not alone in this predicament. Several of Trump's other picks for U.S. attorney across the country are facing similar opposition and procedural hurdles, highlighting the broader tensions between the White House, the Senate, and the judiciary over federal prosecutorial appointments.

Are you saying the judge is partisan? Can you explain what you think is partisan about his decision? So you think any judge who rules against Trump is biased? Please provide an example.

Clearly, Trump needs to have this judge removed from the bench. How dare he rule against Trump. This is an outrage.

According to Trump himself, the US Constitution says he can do whatever he wants. This out of control judge needs to learn his place.

As a long time personal friend of Brann (I have known him since childhood), I can tell you he is as conservative judge as they come. He was a member of the Federalist Society.

The reason he is appointed by Obama is a result of tradition when Pennsylvania Senators are of the opposite party. For every three nominees the Senator of the same party of the President recommends, the Senator of the other party gets to recommend one nominee. In this case, Pat Toomey recommended Brann. Obama accepted all the recommendations (including Toomey's) to ensure all his Pennsylvania nominees got confirmed.

That is why Obama appointed a judge 100% opposite of the philosophy you'd expect.

So how do you feel about Trump violating the law to circumvent the Constitution's requirement that U.S. attorneys must be confirmed by the U.S. Senate?

I realize that since TACO's first administration, that's become a practice but was Obama "practicing" it?

And that's where this indian went off the reservation. The Constitution says what Trumps says it says. This rogue judge is going to pay a heavy price for failing to rule in favor of Trump.

Do you understand how the justice system works? The judge opines on whether a particular matter brought before her (she does not initiate such) is legal or not. Her ruling isn't a personal opinion, but her expertise applied to a particular legal question.

His Republican Senate wouldn't give her a confirmation hearing. By law, the Attorney General cannot appoint her to be a U.S. Attorney. Trump has a constitutional obligation to nominate someone else to that position. Instead, he allowed her to remain, thumbing his nose at the constitutional requirement to appoint a U.S. Attorney with the advice and consent of the U.S. Senate.
