Undocumented immigrants generally have limited access to publicly funded healthcare benefits in the U.S. They are largely ineligible for programs like Medicaid, Medicare, and subsidies through the Affordable Care Act (ACA) marketplaces.
However, there are exceptions for emergency care.
Emergency Medicaid
- Federal law mandates hospitals to provide emergency medical treatment, including labor and delivery, regardless of a patient's ability to pay or immigration status.
- Emergency Medicaid is a joint federal and state program that reimburses hospitals for providing emergency care to individuals who meet Medicaid's income requirements but are ineligible due to immigration status.
- Spending on Emergency Medicaid accounted for less than 1% of total Medicaid spending in FY 2023, totaling $3.8 billion.
- Much of this spending goes towards labor and delivery costs.
State-funded healthcare
Some states provide healthcare coverage to undocumented immigrants using state-only funds, expanding access beyond emergency care. Eligibility and benefits vary by state. As of April 2025, 14 states and Washington D.C. offer state-funded coverage to children regardless of immigration status. Seven states (California, Colorado, Illinois, Minnesota, New York, Oregon, and Washington) and Washington D.C. also provide this coverage to some income-eligible adults. Some states have recently considered or implemented program cutbacks due to budget concerns.
"AI generated"
Everyone knows money is fungible. Which simply means money diverted for one use can be replaced by federal funds for another use. This happens all the time. If the states got less federal funding, they would very likely spend less on providing illegals with services they can't get through federal dollars. The federal dollars allow this to happen. The bigger problem is illegals in the country getting benefits, such as free public schooling and programs that go with it. While this seems to be a charitable endeavor, just as free hospital care, all must be paid for by someone. These practices encourage more illegal immigration and that's a problem and it's against our law.
