Because having classified information on her unclassified computer or server would be a crime. So she would not want to admit to a crime.

She didn't know it was there, it was sent to her without markings.

More likely transcribed or paraphrased. So, for example, [EXAMPLE ONLY] if I get a TS//SCI briefing that "General Smith has begun to move forces around the capital of Arcadia, and may be about to launch a coup against President Jones", and then I turn around, hop on gmail, and send a quick note to my boss saying "Hey, be on the lookout for a possible situation - I talked to NGA and it looks like Gen Smith in Arcadia might be about to launch a coup".... [EXAMPLE ONLY]

then I would produce emails that look roughly similar to how these are reported.

So she could try to run with the incompetency argument - that she didn't realize that reporting streams out of those agencies would be classified because gosh silly old grandma me, can't handle two electronic devices, sattelites up in space you say? Gosh what won't they think of next.....


.... until it came out that some of the information being passed around was also FGI (Foreign Government Information). Which is also classified at birth, and is State Department. So, she would have to argue that she had no idea how she was supposed to do business as the Secretary of State in order to make that argument stick.

It would sort of be like Obama suddenly discovering that he's the Commander in Chief, 6 years into his Presidency. Gosh, you mean that's why the Joint Chiefs are always briefing me on stuff?

Likely speed and convenience. Secret and TS networks have to be specially maintained, placed, protected, etc. For Principles like SECSTATE, we can go to some ridiculous lengths to make it easy and accessible, but your accounts and devices are still going to be split up. She can message back and forth with her aids on a blackberry while in a conference, or waiting for the Parade of Grand Pumba's to finish, or whatnot on an unclassified line - you can't do that with a classified one.

Then, afterwards, to keep precisely these kinds of revelations from happening.

Note Pete, is says the classified information found in Clinton's email trove. Imagine that......finding classified information in a Clinton Squeezebox.

That leaves Hillary and her aides.....and the State Dept. That's who it is narrowed down to Pete. Guess which one wont take the weight over its employees.

One, she should't need markings to know some things are classified.
Two, When the information left its respective agencies, it was marked. Someone, somewhere along the way, rewrote it without markings or stripped the markings then cut and paste.

Do you realize INR frequently disagees with the other agencies.

They already know that it wasn't sent to her without markings. That's why they clearly stated the markings weren't removed by any others in the IC.

Yes, but that's irrelvant because they cannot declassify another agency's reports. They can't just decide it shouldn't be classified and then ship around their own version.

How do you get the header information correct?

The header is the highest possible aggregation of all the information contained inside the document.

So, for example [EXAMPLE ONLY

If you take the following information:

TS//SI//REL TO USA, FVEY: This is information that is Top-Secret, derives from Special Intelligence, and is Releasable to the United States and its "Five Eyes" partners.

S//TK//NF: This is information that is Secret, derives from Sattelite Imagery, and is Releasable to US only - NF stands for "NOFORN".

And you put them both together in a document.

Then the header (and footer) would read: "TOP SECRET//SI/TK//NOFORN" , as it would have the most restrictive secrecy level (TOP SECRET), all the caveats in the document (SI and TK, so you have to be read in to both to read the joint paper), and the most restrictive releasability (NOFORN).

[EXAMPLE ONLY

Formal Products and briefs usually also have cover pages and back pages where they put this in big, shiny, colored letters on the front so that it is impossible to miss.

They didn't declassify another agency's reports. They produced their own report not knowing the information was classified. That's the real reason there was there no markings. The other agency found the information while going through her emails. She's innocent of such charges.

Yes. I have gotten into several debates with them myself. They have a very interesting contrarian culture which can sometimes lead them to be very right in seeing what others miss, and can also lead them to being very wrong (personal experience plus experience of others).



Do you realize that the INR is not authorized to declassify other agency's information, and is not an agency with Enterprise responsibility for any intelligence discipline?

So, for example, if an INR analyst - or any other government employee - read a report from the CIA marked "S//NF", that analyst is required by law to treat it as S//NF until the CIA tells him otherwise.
