Trump may have violated copyright law by selling mugshot merchandise

Merchandise emblazoned with the historic photo and the slogan “Never surrender” was quickly hawked for between $12 and $34.
Within just three days, the Trump campaign made $7.1 million off the merch, which included T-shirts, mugs, koozies and bumper stickers.
But legal scholars say that money may rightfully belong to the Fulton County Sheriff’s Office, which took the photo, as US copyright law stipulates that the law enforcement agency that takes a mugshot is the legal owner of it.

Trump just keeps winning. I hope that this costs him a few more millions that he doesn't have. The idiot MAGAs would bought this schlock will donate even more of their money to a fake billionaire.

I don't expect anything to happen about this, but I would sure love to be a fly on the wall watching Trumps reaction if a judge ruled that he had to hand over that money for Fani to use :ROFLMAO:

The image is public domain...

If Trump's convicted, he cannot profit from anything connected to the crime including his mug shot. That's the law as I understand it.

Can he profit from the mugshot now? I don't know.

So that makes how many people who bought that stuff. I don't feel like doing the math but that's a lot of crazies.
I so hope he has to hand over the money. Can you imagine the uproar?

What Federal Law Enforcement Agencies Say About Online Mugshots

Federal agencies have their hands tied when it comes to posting your booking photo or mug shot. Copyright law does not apply; agencies are required to share all records produced by the federal government with the general public.

These federal agencies have no say in what states or other local entities do with arrest details, mug shots, or other records collected. As long as privacy laws are adhered to by the individual states, police photos and images collected as part of an arrest will be shared with the public.

In Georgia, where Trump’s mug shot was captured, the Official Code of Georgia (OCGA) does not explicitly dedicate mug shots to the public domain.

That's about sharing. What about profiting?

It should be noted that the law does permit a mugshot to be used in the publication or dissemination of news, commentary or advertisement by a newspaper, periodical, radio station or network, or television station or network.

That should be compensation for the security costs the county will have to bear for trying his sorry ass.

That is just tff

All of that is covered in the source I posted.
"Mug shots may or may not be part of the public domain; under federal government guidelines, mugshots produced by federal agencies are automatically included, while documents, records, and images produced by state or local agencies are governed by unique laws. Many states have passed laws regarding the sharing or distributing of certain public records, including that mug shot or arrest photo from your interaction with the police department."

The federal government chose to make theirs public domain; Georgia did not.

Bwahahahaha

I guess this is what you get, when you hire criminals to be your lawyers.

Meh - if they didn't want people using it, they shouldn't have released it into public domain.

Great. If you need further clarification, here's the Georgia rules...

Does that go for art, movies, and TV shows, too?

Hint: no

Art, movies an TV shows created and released by government agencies...

Hint: Yes
Well that's not true.

Use the seal of the governor of Georgia on letterhead.

Report back.
