(CNN) Alleged DC sandwich thrower charged with a misdemeanor after grand jury rejects felony indictment

It seems it's not so easy to indict a Ham Sandwich, nor the thrower of it, as once was thought!
Yesterday, a D.C. Grand Jury refused to indict the individual the D.O.J. arrested in D.C. for throwing a Subway sandwich.
In fact, now the Feds are refraining from using a Grand Jury at all. Instead they are attempting to go directly to a Federal Judge, not with a "complaint" - but by filing "information" of a misdemeanor - thereby skipping the Grand Jury and hoping a Judge will allow a case to proceed.
I'm thrilled the Grand Jury rebuked the government, and hope the Judge does too. If the misdemeanor case gets taken up by the Court, I hope the alleged defendant moves for a jury trial. Make them work for everything.

Previously, the Justice Department said in court it was charging Dunn with a felony assault charge but, after a grand jury declined to hand up an indictment in the case, have now filed a lesser misdemeanor charge, cutting the maximum sentence from 8 years in jail to 1 year.
--Since prosecutors filed the charges by information – instead of by complaint as they previously did – they can skirt around using a grand jury and instead go right to the judge, who would need to decide whether there is probable cause and the case can proceed.
