(CNN) Alleged DC sandwich thrower charged with a misdemeanor after grand jury rejects felony indictment

Previously, the Justice Department said in court it was charging Dunn with a felony assault charge but, after a grand jury declined to hand up an indictment in the case, have now filed a lesser misdemeanor charge, cutting the maximum sentence from 8 years in jail to 1 year.
Since prosecutors filed the charges by information – instead of by complaint as they previously did – they can skirt around using a grand jury and instead go right to the judge, who would need to decide whether there is probable cause and the case can proceed.

It seems it's not so easy to indict a Ham Sandwich, nor the thrower of it, as once was thought!

Yesterday, a D.C. Grand Jury refused to indict the individual the D.O.J. arrested in D.C. for throwing a Subway sandwich.

In fact, now the Feds are refraining from using a Grand Jury at all. Instead they are attempting to go directly to a Federal Judge, not with a "complaint" - but by filing "information" of a misdemeanor - thereby skipping the Grand Jury and hoping a Judge will allow a case to proceed.

I'm thrilled the Grand Jury rebuked the government, and hope the Judge does too. If the misdemeanor case gets taken up by the Court, I hope the alleged defendant moves for a jury trial. Make them work for everything.

If you are a real criminal, especially a fraudster, Trump is a gift.

Hes a god to you.

Fighting crime is a simple juggling act of priorities and the US has worked itself into such a frenzy that they’re missing that almost the entire federal security apparatus is being geared towards immigration enforcement and going after anyone who they “feel” is obstructing or opposing it, even with a simple sandwich, with crumbs apparently left over to go after the Presidents political enemies.

For all other criminals, it’s open season on the American public.

Are the police in possession of the alleged weapon? If not I'd say toss the case.

After a jury of peers NO BILL the supposed slam dunk case KING MAGATS DOJ seeks a go around with a misdemeanor charge.

Got to get that pound of flesh for the terroristic dude brandishing a Foot Long with lethal intent!

Let us call this what it really is.

MAGAT LAWFARE

Yeah, J6'ers pardoned and feted by KING MAGAT after Capitol Officers brutally assaulted by those Trump Fans.

But toss a Foot Long against the chest of an officer in protective riot gear and Trump's DOJ Boys and Girls want to crucify the dude.

Hypocrites.

The next time he should get Limburger on his sandwich. Then all he'd have to do is open it! (y)

:ROFLMAO: (y)

But I like limburger cheese. :(

Argh!

In Indonesia there's actually a law making it illegal to eat Dorian on public transport.

I think there should be a Western Corollary with Limburger! (y)

BAN ASSAULT SUBS!!!

Especially Foot Longs!!!

Long subs are fine. The real problem is those snubby pocket-subs, the so-called "Saturday Night Subs"! They're easily concealed (unless of course they're Limburger; all Limburger subs should be banned; they're easily the deadliest; then, tuna).

If he really wanted to do some damage he coulda just ate a tuna fish sandwich and breathed on the cop...

If the judge tosses it, that means one thing: it was legal behavior. The officer should track the guy down once a week and pelt him with a sandwich.

Because it'd be legal.

I think the perpetrator will be held to some form of charge, likely a misdemeanor - receiving a slap on the wrist or a warning.

But the important thing is the government cannot attack the citizenry with felony pursuit for minor offenses.

A misdemeanor is probably more in line with the actual act. In the end, it was a sandwich, it's a far cry from a felony. They can probably get a misdemeanor to stick.

If the guy was a Trump supporter he'd be arrested and put in solitary confinement until his trial....average wait time 2 years. He'd be facing a 20 year sentence for assault and obstruction of justice.

Trump's bookkeeping of payments to Stormy Daniels was a far cry from even being a single misdemeanor ...and was a far cry from being a felony...let alone 34 felonies. it WILL be overturned.
