No, the dems didnt make their case. To get the senate to vote for removal, you have to first move public opinion. That didnt happen. Thats why he is still there.

That (bolded above) sounds ominous until one examines the McCabe "case" of the IG identifying "clearly criminal" conduct which resulted in exactly zero prosecution. The basic problem is getting those underlings (or supposed overseers) to testify that they assisted (or stood silently by and allowed) them to do something criminal (for years?) - how, exactly, is that going work without offering amnesty to a significant number alleged co-conspirators?
Here is the problem Comey set a new standard in government malfeasance when he let hillary walk He created the "I didn't intend" defense. Which basically allows for any criminal
behavior as long as the person didn't intend to do it. In fact that was McCabe's entire defense. I didn't intend to lie or mislead investigators but i did it anyway knowing i was doing it.
This whole intent thing has opened up a free pass as an excuse when there are some laws that do not require intent.
Sure. Its possible to believe that what Trump did was wrong but not something for which he should be removed. Maybe if dems had completed the investigation, got witnesses on record testifying against Trump, you might have gotten him. But the dems were in such big a hurry to impeach they forgot to make their case.

I think it is more basic than that - how would one then justify not prosecuting any (and all) "leakers" of information about ongoing federal investigations as well as those (in the media) who helped to disclose them? Once a precedent is set then it's hard to get all of that toothpaste back into the tube, meaning that the "just us" system (and the press using "unnamed sources" inside the DOJ?) would be forever changed.
Then you wait. Thats how it works.If the House would have pursued the court route to enforcing subpoenas we'd likely still be waiting.
I dont think Roberts could have or would have ruled on executive privilege arguments. Thats not his role. It didnt matter since you didnt get the votes to call witnesses anyway.The senate wouldn't have that problem with the Chief Justice presiding but blaming the House carried the day.
