Nope.

Grubb, positioned in front of the vehicle (a failure of basic police safety training), had sufficient time to get out of the way but chose to use lethal force.

As opposed to letting perps use a car as a weapon to flee the scene of a crime?

Law enforcement is obligated to use deadly force as a last/necessary resort. If that means allowing a suspect of a non-violent crime to temporarily evade arrest, the officer was obligated to do so.

There was no justification for Grubb murdering Young.

Yes.. putting yourself in front of a car does not equal a "perp" using it as a weapon. Same concept thus my apt extrapolation.

What constitutes the fool using it as a weapon was accelerating it towards the officer in response to a lawful order to exit the vehicle. Darwin claimed another one that day.

Not sure a bench trial would be to his advantage, although it probably would allow him to avoid risk of an emotional jury convicting him on the more serious charges.


Franklin County Judge David C. Young, who is no relation to Ta'Kiya Young, ruled that the local publicity of the case has not been so intense that the court should dismiss the processes for finding local, unbiased jurors. The ruling states the jury process will start at the end of October. Testimony is expected to begin in early November.

Grubb's defense team told the judge that without a change of venue, they may seek a bench trial. That's when a judge decides whether a defendant is guilty instead of a jury.
 
Additional information on this...another officer in that county was convicted of murder. Three other officers have trials pending - including Grubb.

I thought it was interesting that one of the concerns cited by the defense was the number of local police shootings and trials could bias the jury...

For the first time in Franklin County's history, a former Columbus police officer is behind bars after his conviction for murder in the death of an unarmed Black man. Adam Coy's conviction and July 28 sentencing to life in prison marked a critical moment in Columbus, coming after years of Black Lives Matter, civil rights and police reform demonstrations and protests that put pressure on civic leaders and prosecutors to bring more scrutiny to police killings.

Three other law enforcement officers in Franklin County are awaiting trial on similar charges, and Coy's defense team has signaled that it intends to appeal his conviction in the Dec. 22, 2020, killing of Andre Hill.

In the four and a half years since former Columbus police officer Adam Coy fatally shot Andre Hill, law enforcement officers in Franklin County have killed at least 27 people.
