if the ninth or tenth amendments can be read to create a power for the federal courts to strike down state laws against abortion, sodomy, interracial marriage etc, why shouldn't the courts also strike down laws against gun ownership by honest people EVEN IF THE SECOND AMENDMENT didn't exist?

I like it when federal courts strike down state laws that improperly restrict the rights of citizens. many of those state laws actually violate their own constitutions. NYS has a clear second amendment provision that its POS politicians and equally vapid judges ignore constantly.

A Progressive would marvel at your stance... if it can be called that. Those rights you feel are court generated you like if you agree with the ruling but the same judge is vapid if he/she doesn't rule as you wish on the 2ndA... :confused:

Dersh is a rabid loud mouth, he uses a partisan broad brush. He claims he knows much about liberals and that foolish. He creates a strawman out of a few partisan liberals and tries to persuade everyone ALL liberals want... put in the rabid right tirade of the week.

What the states rights crowd think, in view of Heller and McDonald, does not matter.

The Second Amendment is not a state's rights issue anyways. :shrug:

ah there's that passive-aggressive attempt to dispute the point I made without actually addressing it. Notice, you don't actually dispute for Professor Dershowitz says. But you don't like the fact that he is attacking "your side" so you attempt to dispute it without actually saying anything

He obviously knows what it is-and its virulently anti gun. His posts play a delicate balancing act of pretending not to support gun bans while attacking any post that takes issue with the obvious gun banning attitudes of the Democrat party.

It doesn't seem so delicate in the end. He's simply accepting and endorsing something by proxy. All that stuff in the democrat platform - limiting magazine size and the other incremental initiatives - are the steps toward a ban, and everyone knows it. Some just aren't honest enough to admit it.

This entire thread is based on one man's opinion. He is entitled to it....but it is nothing more than that

Professor Dershowitz is probably the most famous constitutional scholar in the USA. He is famous not only because he is a top professor at one of the very best law schools in the world but also because unlike some other top professors (such as Yale's Akhil Reed Amar or Eugene Volokh of California) he also has engaged in trying some high profile cases such as the appeal of Claus Von Bulow's murder charge. AND he is a well known Liberal. so when he criticizes liberals for their silly distaste for the second amendment, that matters. It might not matter to those who don't understand constitutional theory and it certainly doesn't matter to those who dislike gun owners for reasons other than the facades they spew in an effort to pretend its about crime control. but for people who actually pay attention to legal theory and constitutional issues, this guy is a major leaguer

in court most people cannot offer opinions unless the court determines they are an expert. Dershowitz is an expert in constitutional law meaning his opinion has far more value than say people who have no training in the area

many people correctly note that "everyone is entitled to have an opinion" but they then incorrectly assume that each opinion has equal merit. They don't.

During a recent appearance on Newsmax TV, Harvard Law Professor Emeritus Alan Dershowitz said the Second Amendment is an “absurd thing” in our constitution and that our legal framework needs to be adjusted “to create a presumption against gun ownership instead of a presumption in favor of gun ownership.”
Dershowitz said:
We have tried an experiment for the last 250 years and it’s failed miserably and we have to start a new approach. The new approach has to be guns should not be available to people generally, except if they have a significant need.
If I could write the Bill of Rights over again, I would skip amendment number two. We’re the only country in the world that puts in our Constitution the right to bear arms. It’s an absurd thing to be in our Constitution, but it’s in our Constitution. We have to live with it.
He then referenced the attack that killed two people in the Grand Theatre in Lafayette, Louisiana, saying, “Guns have to be well regulated and they are not well regulated in this country. We’re going to have these kinds of massacres over and over and over again until we change the gun culture and the National Rifle Association is part of the problem, not part of the solution.”
Dershowitz contends that if you want a gun you should have to go to the police or other authorities, borrow a gun for self-defense purposes or hunting, then be required to return it when finished using it.

What is needed is some very tough legislation both on the federal and state level to make it much, much harder to get guns and to create a presumption against gun ownership instead of a presumption in favor of gun ownership, consistent with the well-regulated militia language of the Second Amendment.

I realize you aren't an attorney

in court most people cannot offer opinions unless the court determines they are an expert. Dershowitz is an expert in constitutional law meaning his opinion has far more value than say people who have no training in the area

many people correctly note that "everyone is entitled to have an opinion" but they then incorrectly assume that each opinion has equal merit. They don't.

I have changed my view on Dershowitz. His opinion is VERY valuable! LOL
