Generally murder, rape, etc are not prosecuted under Federal law unless there are some extenuating circumstances that give the Feds jurisdiction like crossing state lines, etc.
You are correct. But the Constitution does not specifically mention that it has the power to prosecute across state lines (I don't think -- someone will gainsay me if it does :P) … and there also a number of other things that were not in the Constitution, for example, the laws that desegregated the nation (Which was justified under the Commerce Clause, even though the commerce clause does not specifically mention desegregation). And then there's also the fact that SuperMax prisons, some (all?) of which are federal are not in the Constitution. I don't believe it specifically says, "Congress shall build prisons."

My point is, square the circle for us. If you are really that ardent believer of the Tenth Amendment, then you've gotta get rid of every last law that is not specifically called for in the Constitution. Is that what you truly mean, or is there some sort of cutoff point for you?
