2 Capitol Police officers sue Trump for physical and emotional injuries from Jan. 6 riot - ABC News (go.com)

Two Capitol Police officers filed a civil suit Tuesday against former President Donald Trump for physical and emotional injuries they say they suffered as a result of the Jan. 6 Capitol riot.

In the lawsuit, James Blassingame, a 17-year veteran of the force, and Sidney Hemby, who has served as a Capitol Police officer for 11 years, quote Trump's words leading up to the riot, including Trump's baseless claims of voter fraud and his assertion that Democrats were "trying to steal" the election.

The suit, filed in federal court in Washington, D.C., demands an award of at least $75,000 for each officer for each of the five alleged counts against Trump, as well as punitive damages and costs associated with the litigation. The counts include directing assault and battery, aiding and abetting assault and battery, directing intentional infliction of emotional distress, and violating D.C. statutes against incitement of a riot and disorderly conduct.

...and they'll be able to use his words after 1.6.21 against him as well.

You can’t sue a federal government employee and win.

Ummm, that $75,000 for each of five heads of damage, so that's $375,000 each. Then there are punitive damages which could be as much as 10 times, so that takes it up to around $3,750,000.

Sure Mr. Trump can afford that, but it would cost him that much in legal fees (assuming the lawyer is smart enough to demand payment in advance and gets a signed retainer agreement wherein Mr. Trump specifically agrees that the lawyer's engagement ceases - at the sole and unfettered discretion of the lawyer - whenever the lawyer does not have sufficient funds in their trust account to pay the whole of the remainder of the lawyer's estimate of their total legal bill - regardless of whether such a condition has occurred previously and been waived).

The "trick" to "nuisance lawsuits" is to sue for just enough less than defending the action is going to cost so that the defendant -pays you to go away- makes a reasonable settlement offer.

Except he didn't, so that's a pretty big stumbling block.
Yes he did, he planned the event for weeks, and every single one of his actions and tweets including his speech, Don Junior's speech and Giuliani's "trial by combat" speech made those angry-riled up hillbillies storm that building. That was his intention. The ****ing event was called "Stop the Steal" Trump knew exactly what a bunch of low information rednecks were going to do..

They would have a better case against their employer for failing to provide adequate staffing.

Missed his speech that morning, all the ones tbe previous month and the millions of dollars in adds did ya???

All the people testifying that they were under trumps orders???

Their employer was trump, however I just think they want to get a court ruling that he is guilty (as we all know he is) of inciting a terrorist attack/insurrection...

However, if the (S/I/T) Trump long time planned event on 1/6 to block the counting of the electoral votes to cement Biden as our president never happened, these Capitol police wouldn't be suing (S/I/T) Trump for physical and mental damages incurred because of the insurrection event.

Exactly, trump spent over a month telling his supporters to come to DC it's going to be wild...

Kinda like the guy who as prank started the are 51 gathering.

He had to back off and discourage people from going because he would be held responsible for any and all repercussions.

Trump never backed off...

The capitol police report to congress... essentially Nancy Pelosi.

He's allowed to contest the votes, and even to give a speech.

Arguing that this was a planned event, with a potential for violence, would support a lawsuit against the capitol police, sergeants at arms for congress, and speaker of the house that they left the officers with inadequate support. Much stronger case than suing someone that wasn't even there.

But not with the intention of gathering people to attack our nations Capitol, which is what he did and exactly what happened...

It’s $375,000. Five counts times $75,000. It’s still too low.

But then, these suits are on the latest in a logjam of litigation, criminal, bank fraud, and tax investigations.

The votes were contested, since the day after the election many times and rejected. 1/6 was simply ceremonial, while the vote was certified for show. Since early Dec, I believe, (S/I/T) Trump called his loyal nut jobs to gather on 1/6 and he and his motor mouth pals ginned that crowd up to march on the Capitol Building. Yes, it's his right to blabber as he's always done, but it was still his call to get those 1000s of morons there and foaming at the mouth over the election results. The Capitol police suffered injuries and death ONLY because Trump encouraged those potential attackers to be there at the Capitol. Trust me, if Biden had done what (S/I/T) Trump did, I'd be calling for Biden's ass. Or anybody's else's ass who caused this to happen for that matter.

That’s is false, they do not report to her or follow any orders from her. She is not in their chain of command

I'd agree that the sergeant of arms dropped the ball by not preparing (in discussion) the Capitol police better for the expected crowd size outside the Capitol Building during the planned event, but the onus of said planned event and ginning that crowd into a high fever pitched march on the Capitol is still owned by (S/I/T) Trump, his family members/friends, Giuliani and Mo Brooks. The issue about the Capitol police being inadequately prepared should be addressed to the Sergeant of Arms - both chambers.
