I wouldn't say the government has failed miserabley. It might be a good idea however to take some of the tasks of education away from states and put them in the hands of the national government. -
No smoking
I'm fine with a ban on smoking in public places. Somoking around people is like assaulting or even killing another person. No matter what the circumstances private businesses do not have the power to allow people to kill each other under its own roof. -

Even after the 14th amendment was created segregation was still declared constitutional (by an act of judicial review) in the case Plessy v. Furguson. The court was hardly upholding minority rights here even thogh the equal protection clause existed. -

Well the school should send out a permession slip to your parents asking to take you off of school grounds during a certain allotted time. Just explain to your parents your feelings and if they decide not to sign it then the school won't be able to take you off the campus. -
