    How about the power to use ICE to protect us from foreign threats but abuse it in sweeping people up off the street? The power to audit taxes but abuse it by going after political opponents?

    I don't see much common ground between the two, I don't agree that the federal government is too powerful, but that it must adhere to the rule and the norms of law. Congress has powers over the president. Not only are they afraid to use it they are willingly giving it away to him.

    I don't think the point is to give up, but to recognize that the solution to our problems can't be fixed by merely trying to pass laws. Really, the Dems need to campaigning on rewriting the Constitution - something the right-wing has every intention of doing.

    Its pretty interesting to watch the Supreme court ignore the Reconstruction amendments.
