A word processor accused of stealing damaging documents about electronic voting machine manufacturer Diebold Election Systems was arraigned Tuesday on three felony counts.

Stephen Heller was charged in Los Angeles Superior Court with felony access to computer data, commercial burglary and receiving stolen property. He pleaded not guilty.

"It's a devastating allegation for a whistle-blower," said Blair Berk, Heller's attorney. "Certainly, someone who saw those documents could have reasonably believed that thousands of voters were going to be potentially disenfranchised in upcoming elections."

The charges arise from Heller's alleged disclosure two years ago of legal papers from the Los Angeles office of international law firm Jones Day, which represented Diebold at the time. Heller was under contract as a word processor at Jones Day.

The documents included legal memos from one Jones Day attorney to another regarding allegations by activists that Diebold had used uncertified voting systems in Alameda County elections beginning in 2002.

In the memos, a Jones Day attorney opined that using uncertified voting systems violated California election law and that if Diebold had employed an uncertified system, Alameda County could sue the company for breaching its $12.7-million contract.

The documents also revealed that Diebold's attorneys were exploring whether the California secretary of state had the authority to investigate the company for alleged election law violations.

The Oakland Tribune published the legal memos on its website in April 2004. By then, the issue of whether Diebold used uncertified systems was already receiving widespread attention, because many of its systems failed during the March 2004 primary. As a result, poll workers had to turn away some early voters in San Diego County, and Alameda County voters had to use paper ballots.

A subsequent report by the secretary of state's office found that Diebold had marketed and sold its systems before gaining federal qualification and had installed uncertified software on election machines in 17 counties.

I think these accusations are rather absurd and belong in conspiracy theory forums.The democrats cried like punk *** sissys when Gore lost to bush and did everything they can to try to discredit Bush by claing election fraud.When John Benidict Arnold Kerry lost to Bush the punk *** sissies tried to discredit Bush by again claiming election fraud.Ever heard of the saying that if you cry wolf too many times no one will beleave you?

Getting arrested and getting sent to a nuthouse for medical treament are two different things.

The article that I posted this thread about was about a whistle blower. Did you bother reading it or did you just assume, like most neo-cons, that since I'm not a Bush lovin' corporate baby like you that I only post lies? Wake up man, the republicans are the ones lying to you. We are trying to open your eyes. But I'm sure that instead of trying to see the light of day you'll just continue to blindly bash all those who don't agree with you. Was there illegal activity in the 2004 elections? Yes. Was that illegal activity enough to make the difference and give Bush a state that was not his to have? No.

Bush did win the election fair and square. The illegal activity does give some on the other side a platform to rant on, and that is too bad. If the illegal actiivity had never happened, Bush still would have won in 2004, so this whole so-called conspiracy is a non-issue.

What should happen? Those who participated in vote fraud should be locked up. Also, Tom Noe and others in Ohio who laundered money to the Republican Party should go to jail. This appears to be happening. Oh, and one more thing. You Democrats should concentrate on real issues. There are enough of those around, thanks to Bush, so you dont need to focus on what-if conspiracy theories. But something tells me that is what you will keep doing. No wonder you guys keep losing elections.

Have you read my profile? I'm not a Democrat though I do believe they are the lesser of two evils. I'm not sure what I am exactly but i figure that Socialist is the closest. I may be a Libertarian. And i'm glad that unlike me you DO see one party as being solely good and the other totally evil. Also I really don't want to bring up how easily the powers that be could have rigged the 2004 election.*cough* Ohio *cough* Diebold. *cough* "I am committed to helping Ohio deliver its electoral votes to the president." *cough*.
