My assumption is Graham is forcing this to become an issue for some higher court to deal with.

**** if I know, but... maybe... because we truly have a modern day government aristocracy and perhaps this issue is the best most elegant proof that I am dead on right on this.
 
This is a nothing burger. He was not required to attend. It was a court hearing on whether Graham should be compelled to testify...not the actual case. He was not required to be there just his lawyer.

This was a hearing arguing whether he had to appear before the Grand Jury or not. His attorneys were arguing the specifics and there was no need for him to be there. The judges will rule today whether he must appear before the Georgia Grand Jury or not.

Brian Lea, an attorney for Graham, argued that Graham's position as a senator protects him from having to appear before the special grand jury in the investigation into whether former President Donald Trump and his allies committed crimes as they sought to overturn his narrow election loss in Georgia."
