Legislation has finally passed to make upskirting a criminal offence in England and Wales. The result follows months of hard work by Gina Martin, a woman who was a victim of the offence and worked tirelessly to bring the issue to light. The new legislation – which was passed in the House of Lords yesterday and now awaits the formality of Royal Assent – makes upskirting a criminal offence that will be punishable by two years in prison, and, in the most serious cases, will result in those convicted being added to the sex offender register. The newly outlawed act is the taking of unauthorized, sexually intrusive photographs underneath a woman's skirt. Although some acts of upskirting could previously be prosecuted under the Sexual Offences Act, not all were covered by criminal law in England and Wales, although they have been in Scotland since 2010. Martin started an online campaign after police refused to prosecute a man who took photos up her skirt during a music festival in 2017. Because she was wearing underwear, the photograph had not been deemed illegal. As the bill passed through its final stage in the House of Lords yesterday, Miller took to Twitter to thank those who worked with her on the campaign and to express her delight at the result.

I am pretty sure this is mostly urban legend, but any excuse to expand the Law Book especially when Victim Culture is at the same time promoted is not to be passed up.....there is a job to do.

It's the cowardice of those not having the courage to actually lift the skirt and then gaze. They fear having their gonads trodden upon.

I'd happily volunteer even where I don't wear skirts at all.

Good move. This should be a crime, though a 2 year sentence seems a little steep but I could be persuaded otherwise. I'd like to see what other crimes gets 2 years there.
 
When I was in 2nd grade I loved pushing the girls on the swing so I could see their underwear.In high school I had mirrors on my shoes.I outgrew this perversion eventually.Next week makes 1 month now.

In an effort to crack down on the alleged "tidal wave of abuse and harassment" women face every day, the county's police force is now considering things like catcalling and pickup lines to be a hate crime if they are directed toward a woman from a man.

The incredibly vague definition of a misogynist hate crime from Nottinghamshire reads: " Incidents against women that are motivated by an attitude of a man towards a woman and includes behavior targeted towards a woman by men simply because they are a woman."

Of course, that could include anything a woman deems offensive or unwanted from a man. It's completely subjective. If a man approaches a woman in a bar and attempts to flirt with her, but she doesn't find him attractive, he could be guilty of a hate crime. Unattractive men, beware.

Newsweek reports that now "everything from verbal comments to unwanted physical approaches" will be considered a hate crime.

I agree this is creepy and offensive behavior. But two years in prison? I can see a week. Maybe two. But two years?!! That's the equivalent of a felony. Seems a bit much, doesn't it?

Feebly attempted to find corroboration in post #12 by the citing of an over 2 years old news article from a website outlet that barely finds readers outside of D.C.

The true picture is (of course not from our resident distortionist) that any case considered worthy of pursuit would involve (as a police spokesperson explains):
"One of the main reasons we decided to introduce this category of hate crime was to give women the confidence to report men who are behaving inappropriately—be that unwanted physical contact, being verbally abusive or making uninvited sexual advances."
as a newer report shows, even where it's also over a year old.

Yeah sure. I have no reservations about it being a crime. But a 2-year prison sentence as punishment? Seems a bit draconian. It's starting to sound like the Saudis with their chopping off of both hands of anyone caught shoplifting.

Your equivalence of incarceration with mutilation is disingenuous and apples to oranges.

2 years is the maximum. Most sentences in most crimes don't get set at the full maximum. My guess is the statement "2 years" is meant to be there to discourage possible pervs doing it. Anyhow, some states in the US and Australia have the same approach. South Korea has an epidemic of up skirting and a 5 year sentence with a £5000 penalty - however actual sentencing in S Korea is extremely lenient.
What is more important than length of sentence is wholesale cultural change and education.

So if the punishment having to be commensurate with the crime is no longer a legal or ethical principle, but only deterrence matters, why not reinstitute death by drawing and quartering right away?

Why institute death if just the threat of 2 years achieves the purpose of wholesale cultural change?

You quoted me but didn't read what I said..... I mentioned cultural change and education. (Unless education in your world includes arcane medieval punishment?)
