President Donald Trump is expected to sign an executive order on Monday cracking
down on suspects who desecrate the American flag, including burning it, by
mandating they face prosecution, Fox News Digital exclusively learned.
"The American flag is the most sacred and cherished symbol of the United States of
America, and desecrating it is uniquely and inherently offensive and provocative. It
is a statement of contempt and hostility toward our Nation, and an act used by
groups of foreign nationals calculated to intimidate and threaten violence against
Americans," a fact sheet on the order provided to Fox News Digital reads.
The executive order will direct the attorney general to prosecute those who violate
laws "in ways that involve desecrating the flag," and to pursue litigation that would
clarify the scope of the First Amendment as it relates to flag desecration. The order
additionally directs Attorney General Pam Bondi to refer flag desecration cases that
violate state and local laws to appropriate local authorities.
He'll be gone soon enough and the GQP will be held accountable for a very long time. The Mad King’s temporary decrees are getting weirder and weirder.
Another dumbass MAGAt red meat unconstitutional EO.Of course this is an obvious violation of the 1A, but MAGA doesn't care about any part of the Constitution outside of the 2A.

Once more, Trump shows his sheer hypocrisy by signing yet another (illegal) executive order.
I fear this E.O. may have a detrimental impact on some of donalds stauchest supporters.Of course this is an obvious violation of the 1A, but MAGA doesn't care about any part of the Constitution outside of the 2A.

LOL "fondling"But no condemnation of having flags dragging in the dirt on the back of a pick up truck. Or wearing a flag as apparel. Or disrespecting a flag by touching it or fondling it.
And you voted for this shit?unconstitutional
Yeah you are finally getting itunconstitutional
What the order actually is doesn’t appear to violate the first amendment.Of course this is an obvious violation of the 1A…
Sec. 2. Measures to Combat Desecration of the American Flag. (a) The Attorney General shall prioritize the enforcement to the fullest extent possible of our Nation’s criminal and civil laws against acts of American Flag desecration that violate applicable, content-neutral laws, while causing harm unrelated to expression, consistent with the First Amendment. This may include, but is not limited to, violent crimes; hate crimes, illegal discrimination against American citizens, or other violations of Americans’ civil rights; and crimes against property and the peace, as well as conspiracies and attempts to violate, and aiding and abetting others to violate, such laws. What the order actually is doesn’t appear to violate the first amendment.
Prosecuting Burning of The American Flag
By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered: Section 1. Purpose.www.whitehouse.gov
What the EO addresses is flag burning as incitement.Sec. 2. Measures to Combat Desecration of the American Flag. I don't have to be a lawyer to know that's meaningless babble.
What the EO addresses is flag burning as incitement.
“Notwithstanding the Supreme Court’s rulings on First Amendment protections, the Court has never held that American Flag desecration conducted in a manner that is likely to incite imminent lawless action or that is an action amounting to “fighting words” is constitutionally protected. See Texas v. Johnson, 491 U.S. 397, 408-10 (1989).”
And how to go about punishing it:
“In cases where the Department of Justice or another executive department or agency (agency) determines that an instance of American Flag desecration may violate an applicable State or local law, such as open burning restrictions, disorderly conduct laws, or destruction of property laws, the agency shall refer the matter to the appropriate State or local authority for potential action.”
Yes, I read that. There are already laws against incitement. What the EO addresses is flag burning as incitement.
This is ridiculous.“Notwithstanding the Supreme Court’s rulings on First Amendment protections, the Court has never held that American Flag desecration conducted in a manner that is likely to incite imminent lawless action or that is an action amounting to “fighting words” is constitutionally protected.
