Article I, Section 4, The times, places and Manner of holding Elections for senators and representatives shall be prescribed in each state by the legislature thereof; but congress may at any time by law make or alter such regulations, except as to the places of choosing senators.Here you go. The portion about choosing senators was changed by the 17th amendment. The key words are manner of holding elections shall be prescribed in each state by the legislature thereof. That is unless congress makes or alters such regulations. Not the president.
Whether or not mail in ballots are allowed and the type of voting machines or paper ballots are left to the state legislatures per the Constitution. Only congress can change that, not the president and certainly not by executive order. This all boils down to the word manner in which each state legislature determines, not the president.
I don’t consider this a states rights issue, amendment 10. The Constitution is explicit. Article I, Section 2, The manner of elections which includes whether or not mail in ballots are authorized or what type of voting mechanism is used will be prescribed by each state legislature thereof. But congress can at anytime by law make changes or alter such regulations. This is covered by the Constitution itself, making the 10th amendment irrelevant. I have a pocket-sized US Constitution in the drawer next to me. For this to be a states right issue, Amendment 10, the Constitution would have to be mum on who has the power to determine how elections are done. The Constitution isn’t mum, it’s right there in black and white, in plain English. States rights or Amendment 10 doesn’t apply in this case.

You’re correct, I don’t know how I got section 2 instead of section 4. But thanks for pointing that out. I think the Constitution is quite specific and in plain English. However, I don’t speak lawyerese where shall can mean shall not and shall not can mean shall or something akin to that. The bottom line in my opinion from reading plain English in Article I section 4 is only congress can override the state legislatures in the manner or how they conduct their state’s elections.
