Transgender minors have a right to gender-affirming care, Justice Dept. warns states

The Justice Department said last week that states seeking to block transgender minors from accessing gender-affirming care may be violating federal law — and signaled that it is prepared to pursue legal action or support existing litigation against states seeking such restrictions.

In a letter to all state attorneys general, sent on Transgender Day of Visibility (TDOV), the Department of Justice (DOJ) asserted that state laws preventing trans minors from accessing gender-affirming care — by blocking parents or guardians from following a medical professional’s advice, as states like Texas and Arkansas have attempted — may infringe on the 14th Amendment’s equal protection and due process clauses.

The 14th Amendment is very clear that states cannot abridge the rights of any of its citizens. Trans youth deserve access to compassionate, evidence-based medical care, including hormone therapy as they need it. Transphobes can scream all they want to to the contrary, but they do not have the right to deny trans youth this care. :)

Holey Hannah, I've raised three kids and the idea of letting them decide to get permanent, life-changing "treatment" as a minor is not such a hot idea, imho. Considering the degree to which post-surgical trans report continued dissatisfaction and depression, or regret... letting minors with their scientifically-proven-undeveloped brains make this choice, against parental judgement, strikes me as a very bad idea.

Youth today are starving for real fulfillment, and unfortunately modern society isn't cutting it. Being trans is to hate yourself as you were born. This goes along with other human-hating concepts like abortions and global warming.

It's ok to be as you were born. You deserve to be here, the universe created you.
 
Yeah what people don't realize is that we have had laws that grant minors medical autonomy (at different ages, varies by state) for ages. Then states went out of their way to remove that medical autonomy...but only for trans surgeries and treatment. So these laws were undermining existing rights but just targeting a minority.

OK, so you refuse to defend the first statement (basic premise) of your OP. It makes no sense to assert that minors, below the age of consent, have rights to consent to elective medical treatment, get tattoos, buy alcohol, tobacco or guns or to sign binding contracts.

The idea that trans minors have special rights is pure BS. I was simply pointing out that many rights are “abridged” for minors and for perfectly valid state (or federal) interests.

They don't. The care they have been getting is covered under preexisting medical autonomy laws. It was states that went out of their way to specifically target and restrict only medical procedures that pertain to trans people.

If that is the case (that all elective medical/surgical treatments are covered), then yes, but if some elective medical/surgical treatments are excluded then the state should be free to add more.

That's called bluffing, and you're not doing a good job of it. 🤷‍♂️

Meanwhile, my sources say that regret for gender confirmation surgery is no more than 1%.
