I ordered tivo today online however after talking to my local cable company I decided it might be better to go with their dvr instead. So I called tivo back, about an hour after I had placed my order, to cancel. They said the package hadn't shipped yet but I could not cancel. They recommended I refuse the package when it comes. I checked their website and it says I must pay a 15% restocking fee for refusing a package! So I called those bastardz back and started yelling at a supervisor who swore up and down it's impossible for him to cancel my order. How retarded is that? The $hit hadn't even been processed yet and was nowhere near even possibly shipping yet. The freaking supervisor agreed that yeah it hasn't shipped but still their gonna ship it anyway despite my telling them I don't want it because that's apparently just the way it f-ucking is.

Then I found this ditty:

A Business Guide to the Federal Trade Commission’s MAIL OR TELEPHONE ORDER MERCHANDISE RULE

*When You Must Cancel an Order
*You / must/ cancel an order and provide a prompt refund when:

* the customer exercises any option to cancel before you ship the
merchandise;

The FTC's rules seem pretty clear to me. What's the problem over there that the baboon a$$ phone operators don't seem to know the rule?

So I called those bastardz back to fill them in on phone merchandise order rules and tell them to go f-uck themselves only to discover I was too late and they're closed for the day. Also as it was Presidents day I was unable to contact my bank to have them refuse payment.

But those f-uckers messed with the wrong biatch. As I don't have a job I will gladly spend all day on the phone tomorrow harrassing every loser tivo operator that answers the god damn phone over there cause I'll be damned if I'm gonna pay one red cent for some $hit that I attempted to cancel within a timely fashion!

Tivo can suck my husband's left nut. Biatches. What the hell happened to customer service of any type let alone the long forgotten rule that the customer is always right? Bat $hit brained mofos.

Good for you. Let us know what happens. Stand your ground. Oftentimes, they aren't dealing with a tough mofo like you, so they can get away with this bull$hit. But you call them back and read them that FTC rule. I am assuming you charged your credit card. I think you may have to wait until the charge shows up on your bill before you can contest it. But save everything you have, including any notes from your phone conversations, so that if you have to contest this charge on your credit card, you will have all the details you need.

I have Direct TV with the DVR, and I love it. I cannot remember what it was like to not be able to rewind and stop live TV.

I am very proud of you. I am the same way. The squeaky wheel gets the grease, toots!

Well apparently the right to cancel an order prior to shipping is only if the shipping is delayed and the seller can no longer get the item to you in the time they originally stated.

Son of a biatch. So these bastardz are gonna send this $hit to me, that they know I don't want, so they can keep 15% of the purchase price as a "restocking fee." What a bunch of $hit! I order crap online all the time. I've never heard of a company refusing to cancel an order an hour after it was made. Total bull$hit. Stuff like this makes me burning mad. Meanwhile they have yet to charge my card so my bank can't yet help me. They haven't even charged me yet for christ's sake so why won't the f-uckers just cancel. Well I cursed two more TIVO people out on the phone this morning. Did me no good but it felt good to waste their time. I also wrote a letter which won't mean squat but if people like me who have off during the day don't fight these bastardz, who will? :rofl

And now my husband is joking that we should just cancel comcast's DVR and keep the Tivo when it comes because people say TIVO's better.

Uh uh, no way. I don't care if Comcast's DVR bites the big one I will never be a TIVO customer now. They're a bunch of bastardz. Oh how I hate when I feel "wronged." :(

I know how you feel about not wanting to feel wronged. Have you spoken to a manager? You may want to talk to a supervisor/manager and explain your frustration, but don't get mad. Getting mad can work sometimes, but being very diplomatic and expressing frustration can work too. Maybe say something like, "I understand that there is a 15% restocking fee; however, if the box is not opened (like it normally would be), would you consider making an exception for me and not subtracting the 15% from the price?" If they say no, ask for them to just do 5%. If they say not, ask for 10%. Try to negotiate with them. But, again, be diplomatic. Point out that unlike their normal returns, you changed your mind before it was sent out and attempted to cancel. Maybe offer to pay the shipping (if it was going to be cheaper than the 15% restocking fee). See what happens.

I am the hothead between my husband and me. It's amazing how much he can get from staying calm and asking for things. Give it a shot. The worst that could happen is that you're in the same position as you are now.

If you cannot talk to a different manager/supervisor, consider apologizing to one that you have screamed at. People love apologies.

Hang in there.

Ah aps it's way too late. I did get a supervisor on the phone and the conversation promptly ended when I called him a bat$hit brained goat f-ucker! I blame the Irish in me! The guy though was not going to do a damn thing to help me and as far as the restocking fee he said they retain the right to charge it even if I don't open the package as they have to open the package to check it anyway when it comes back. I told him, "Well the package hasn't even left yet!" Duh! He said he understands my frustration but it is the way it is and there's nothing to be done. That's when I lost it and before I even thought about it "goat f-ucker" had blasted across the phone lines. Also they informed me the phone call was being recorded so I'm sure I'm flagged in their system as some sort of insane woman. But you know it still felt better letting the guy have it vs. saying, "okay well thanks for not helping me." :rofl

My husband thinks I'm nuts as he's always rational and sane and he doesn't think the restocking fee is worth arguing over. But for me it's the principle. The company is rotten and their policies stink. I feel like the more bad attitude and treatment we accept the more these companies are gonna feel free to keep dishing it out. I for one will always be the one cursing and thumbing my nose at them because I can be a bigger and louder a$$hole than anyone!

LOL You are one, tough momma.

Maybe you should reconsider the "laid back" under your name. ;)

Nah. I fire up rather quickly but I cool off and get over crap in a timely fashion too. Truth be told I learned a lesson. Their policies are stated on their website albeit in small hard to see places while their MONEY BACK NO RISK GUARANTEE is large, easy to see, and everywhere. The return or repackaging fee is small and you have to dig around on the website to find it.

I guess I have just grown so accustomed to doing business via the internet and phone that I've grown rather lax. I order tons of stuff by phone and internet and haven't had any gripes in a long time. Most companies are quite generous in allowing you to cancel an order that hasn't yet processed or shipped as long as you call within a few hours. Since TIVO is a big well known name I didn't expect I'd have a hard time or be hassled by them. But you live and you learn.

So I'm over it and cooled off. But while I will quickly forgive family and friends for wronging me business is completely different. Once a business (in my mind) rips me off I'm done with them forever. No TIVO in this family's future. I don't care if they invent a box that is capable of cleaning my toilet, floors, doing the laundry, and records my favorite shows. They are dead to me. :rofl

Luckily I was made aware of how they "handle" their customers long before I signed any service agreement setting me up for 3 years of dealing with their hostile phone baboons.

Totally, totally agree. We had a serious mishap with a company. They were incredibly rude. I have told all my friends in the area not to purchase anything from them, and I filed a complaint with the Better Business Bureau. Don't fvck with aps or talloulou. ;)

Also try telling them that you just bought a gun and a plane ticket to Bangalore.
