“Buried in a court filing late Wednesday from the January 6 committee is an explosive email exchange between Greg Jacob, a top lawyer for then-Vice President Mike Pence, and John Eastman, a lawyer who was working with then-President Donald Trump's legal team, that absolutely nails the culpability of Eastman in the events of that terrible day.

The email exchange began on January 5, with Eastman attempting to push the idea that Pence had the constitutional authority to reject certain electors from swing states when the votes were counted in Congress the next day.

On January 6 at 12:14 pm ET, as it was becoming increasingly clear that there was a Trump-inspired riot brewing at the US Capitol, Jacob was unequivocal in his rejection of Eastman's theories.

"I have run down every legal trail placed before me to its conclusion, and I respectfully conclude that as a legal framework, it is a results-oriented position that you would never support if attempted by the opposition, and essentially entirely made up," Jacob wrote Eastman. "And thanks to your bullshit, we are now under siege."

To which Eastman responds: "The 'siege' is because YOU and your boss did not do what was necessary to allow this to be aired in a public way so the American people can see for themselves what happened."
In his next response, Jacob drops the hammer: "The advice provided has, whether intended or not, functioned as a serpent in the ear of the President of the United States, the most powerful office in the entire world. And here we are."

Jacob went on:

Respectfully, it was gravely, gravely irresponsible for you to entice the President with an academic theory that had no legal viability, and that you well know we would lose before any judge who heard and decided the case. And if the courts declined to hear it, I suppose it could only be decided in the streets. The knowing amplification of that theory through numerous surrogates, whipping large numbers of people into a frenzy over something with no chance of ever attaining legal force through actual process of law, has led us to where we are."“

Lawyers can, legally, push arguments which are aggressive, creative, or even just downright crazy. But they cannot, legally, push ideas they know are false.

This little exchange alone clearly shows Trump and his lawyers knew there was no fraud, but were deliberately and aggressively propagating lies and illegal behavior. Eastman was just angry that Pence’ss lawyers were not stepping outside those legal bounds to play along and overturn the legitimate results of an American election, IOW, insurrection.

This by itself is enough to find both Trump and Eastman guilty of insurrection.

Stage five tds was just handed a conviction and is now cooperating with the 1/6 investigation. Seems the proud boys ain't so proud after all.

You must really be held back by your Fox News bubble. We've known for over a year Trump and crew knew there was no fraud. They knew they lost the election. In a criminal case, intent has to be proved without a reasonable doubt. This new stuff we're learning about communications between Trump and some of his advisors is coming really close to proving that. Jason Miller told the committee that he in no uncertain terms explained to the dunce in the WH that no fraud existed. Along with Barr and Crebbs and the director of the FBI.

Trump was also made aware of the fact that the pressure campaign he was putting on the VP was very unconstitutional and very likely illegal. Yet he kept on pushing and kept on lying.

That you don't believe it and continue to defend a common criminal is your problem, not ours. The DOJ should not only be interested in these new revelations, but they are also obligated to investigate it. The 200-page filing went as far as spelling out the statutes that were violated.

I don't think any of this matters. It either represents conclusions long ago reached by many, or it will be ignored by the rest.

If at the end of all of these various investigations, it looks like Trump could/should be charged, he won't be. He is already Person #1 in the Michael Cohen case, a case where guilt has been established. No charges against Trump have been laid and no charges will be. In the American system, where judges and district attorneys are elected, prosecuting a past President is usually going to be considered political. This is particularly true if the illegal activity has political motivation behind it. Because of this Trump will never be charged.

The only one making things up is the one whose opinion is faith based, such as yours.

When one is informed that there was no fraud, from multiple sources, at multiple times, while himself producing absolutely no evidence of fraud; that, in itself, is evidence Trump and Eastman knew there was no fraud.

The 'head in the sand' defense doesn't work. The insanity defense may.

Leader? He was last to close air space to Russia and didn't give Ukraine stingers until Germany did. Now as both parties and even Pelosi call for sanctions on Russian oil he's again last to the party.
