Cue the meltdown because one looks like one could hit liberal America very soon. We’ve been haggling over the citizenship question in the 2020 census. It’s been asked before in past surveys. As the Department of Justice was ordered to look into ways to include the key question, AG Barr recently announced that a path might have been found (via Post and Courier ): Attorney General Barr tells SC reporters he's found a legal recourse on Census question | News | postandcourier.com
Again, the Democrats are going to go ballistic, so grab some popcorn. We’ll see what happens.

I have no problem with illegals being counted... it's nice to know where they're at so we can direct our ICE resources to the right areas. I have a problem with illegals being used for apportionment of Congressional Districts. Besides... Progressive Marxist Socialists/DSA Democrats shouldn't need the illegals with all the dead people they have voting. The Constitution demands that a citizenship question be included on the decadal census. (See: Article 1, Section 2, "The 3/5ths Compromise"). Now, this might seem a strange place to start, but bear with me because the 3/5th compromise is relevant to the constitutional amendment which articulates the need for the citizenship question. That amendment is the 14th Amendment which provided full citizenship for everyone regardless of race. Section '1' of the 14th Amendment defines the criteria for being a U.S. citizen and also states that anyone who is a U.S. citizen is a citizen in all states.
 
if Tweety's undercount attempt succeeds, the tainted census should be thrown out as unconstitutional. my guess is that the attempt will fail. Tweety has already been told no by his friendly SCOTUS.

Free Blacks were counted as whole persons. Asians (who could not be citizens) were counted as whole persons.
There is nothing about citizenship in the general rules for apportionment. In the case that a state denies the vote to any male citizen age 21 or over for any reason other than a crime, then representation is to be dropped by the percent of denied from the whole number of 21+ male citizens.

But that has never been invoked and the citizenship information doesn’t have to come from the decennial census.

(President George Washington and Secretary of State Thomas Jefferson both were skeptical of the 3.9 million count, expecting the number of inhabitants to be higher.)
 
This is actually somewhat plausible. SCOTUS did not rule against the question, just the due diligence. If there is a way to satisfy the Court's objections in the timeframe necessary, it might pass muster.

That said, I don't expect it to work.

You're correct. Trump can use the numbers indicated from IRS Federal returns. This shows the number of dependents and if a person is filing individually or jointly. Another method of tabulation is those people filing for Social Security numbers and payments to SSI. I believe the numbers from IRS would be more accurate in as much as illegal aliens would not be applying for Social Security numbers or benefits. Since Individual IRS tax forms are optically read, it would be simple to tabulate dependents from each household filing their tax forms.....

There still has to be an actual census every 10 years. Tax records would be an enormously difficult inaccurate measure of the population.

Correct there must be a census according to the U.S. Constitution according to Article 1 Section 2. That is so U.S. Representatives be properly assigned. For example 27 U.S. Representatives are assigned for NY State whereas there are only four (4) Representatives assigned for Rhode Island by population Illegals aliens reported as citizens violates Article 1 Section 2 of the Constitution.

And as you see, nothing in there limiting representation to citizens or on the basis of immigration status.

None of this matters. The census is suppose to count permanent inhabitants. It doesn't matter if they are citizens or not, nor does it matter if they are legally in the US or not. If they are permanently living within the jurisdiction of the US, then they need to be counted for apportionment purposes. The US Constitution specifically states that we should be counting "free persons," not just citizens. Meaning all permanent inhabitants currently in the US.

Clause 1 of the Fourteenth Amendment says anyone who is born within the jurisdiction of the US is a US citizen. US citizenship is different from State resident status. Most States require someone to reside in the State for a minimum of a year before granting them resident status. They are still US citizens, just not residents of that State yet if they haven't lived in that State long enough.
 
This question and reaction to the citizen question, comes down to the ability to be truthful on the census, versus the need to be vague. People of honest intent are not afraid of the truth. Those who are afraid of the truth, fear the truth will undermine a scam they hope to run. The Democrats do not care about the immigrants. They care about the scam they hope to run.

A better way to do this is instead of a direct citizen question, we can use a number of innocuous questions from which one can infer things. For example, how long have you been in the USA? We have the exact numbers for legal immigration. One can infer illegals from this data. This does not ask if you are a citizen, or are here legally, but still allows one to guess bulk numbers. It is less threatening.

Wrong.... It's all about the number of U.S. Representatives to Congress. The census also depends on the funds cities and states receive by the Federal gov't. The census needs to be accurate and citizenship versus non-citizenship is at the core. We the People have a Right To Know.....

Citizens are required to file Federal and State income taxes that require the use of their Social Security number, in lieu of a SSN, an Individual Taxpayer Identification Number (ITIN) is required. This nine digit number is similar to the Social Security number but can only be used for filing income taxes. For example Foreigners with green cards, work visas or education visas can apply. Naturally illegal aliens do not apply for ITIN. Illegal aliens use phony SSN's and they due pay city and state taxes when purchasing taxable items. Using a phony or someone else's SSN is illegal and considered identity theft and is punishable by law.

SCOTUS rejected his effort to aid his party. If the new rules are that the executive can defy the SCOTUS, then it's game on for the next Democratic administration.
