In most states (at least here in MN), if the age difference is below a certain number, it's not rape. I think it's 3 years here.

It's a stupid crime predicated on the asinine notion that men and women in their teens aren't sexually mature and that their sexual urges are somehow less legitimate than older adults'.

It is bad enough when the government declares war on economics. Declaring war on biology is an exercise in futility.

Which, in my opinion, make the female's abuse of authority all the more criminal.

Yeah, why don't you ask those young men whether or not they felt "victimized".

I never really understood statutory rape laws.. Was it rape because the two boys weren't willing or just their age??

There is an assumption that men-- or, more importantly, women-- below a certain arbitrary age don't understand what sex entails and thus are not capable of providing informed consent. This age varies from State to State, ranging from a fairly reasonable 16 all the way up to 18 (with various exemptions also varying by State) but most people are operating under the erroneous assumption that it is 18 everywhere because all of the television shows are written in California. In this case, it's 17 in Illinois and the "victim" was 16. In any case, a teacher having sex with her students is engaged in exploitative activity and should not be tolerated; it isn't the age that concerns me, but the position of authority.

By contrast it's 16 everywhere in Canada, but they have special laws regarding "abuse of authority" for men and women under 18. In Mexico, it varies by State from the onset of puberty up to 15 years but they also have "rape by deceit" and "corruption of minors" laws for men and women up to 18 years of age, that require a criminal complaint to be filed by the victim or the victim's family. With the exception of the Mexican age of consent being entirely too low in most of the country, I would consider either of these approaches more rational than our own.

I always found it odd that an 18 year old can't sleep with a 16 year old.. Isn't there an age of consent??

It's 16 in Washington with the exception of people within exploitable "significant relationships", which pertain to abuse of authority.

It's three years if the younger party is under 13. If they're between 13 and 16, it's four years. 16 and up is fair play unless there's an authority issue.

I agree. The law is the law. I just find the moral outrage distasteful.

I don't think the attitude about sex that this teacher is promoting could be any more cavalier than what they're getting from television, though. And it has to be better than what they're learning from Internet pornography.

See, I agree with that statement, but I just don't think that the word "minor" makes a difference. It's the authority that makes it wrong, not the age.

The students were old enough to understand that she shouldn't be doing what she's doing. When an authority figure says it's alright to break the rules, then that's what they learn. When it's about sex, they are learning that they can have it regardless of rules, laws, etc....if it makes em feel good.

I would argue the opposite, given the circumstances. I don't think a 28 year old woman having sex with a 16 year old student has healthy sexual appetites.....

Holy crap, dude. Other students in her school are still students, and she's still a teacher....and she's still an adult, and they're still underage. At the very least, it's still immoral and illegal.

Pedophiles congregate and make a point of being where their desired prey is, kids. The bigger the congregation of kids, the more pedophiles is there any wonder why this happens in schools?. Whats is shocking to most people is the amount of women that are being arrested for pedophilia, even though the media does not apply that label to women as readily as to men. Heres the simple truth women have always been pedophiles just like men and women have been mostly getting away with it forever. Some young boys dont view it as their being abused when its a female abusing them and they dont tell as much.

Not so, all teachers in a school have the same authority and same responsibility for all the students in the school regardless of whether or not they ever teach a student directly.

Think about it...does the shop teacher have every right to bang the Cheerleaders?

hell, they can legally drink and be in high school
but they cannot be sexually intimate with a school employee without that employee also being subject to punishment

Calling someone who has sex with a 15 year old a "pedophile" is an abuse of the English language. It isn't even remotely accurate.

Are there people with a preference for that age range? Certainly. But you know who else finds men and women that age attractive? Everyone.

In theory. In practice they have very little effective power over the student's privileges or academic career. But I think you are right, it does come too close to presenting a conflict of interest.

which i think tells us what we should focus on rather than age

What difference does it make? Either way it's wrong....and statutory rape is wrong. 18:15 not so bad, 40:15 bad.
