A lucky calendar break for the GOP, not unlike that Texas judge waiting until just after Election Day in 2018 to drop his decision granting the GOP's wish to bring back pre-existing conditions. Their 10 million vote margin of defeat was the largest ever for a midterm, but in an election that turned on health care who knows how much larger their losses would've been if that decision had dropped prior to the election.

All the more reason for Dem candidates this year to keep reminding the voters of what's at stake and what exactly their opponents are trying to do.

Supreme Court to hear Obamacare case a week after Election Day

The U.S. Supreme Court will hear oral argument on the future of Obamacare on Nov. 10 — a week after the presidential election — the court announced Wednesday.

The case will determine whether the Affordable Care Act that provides millions of Americans with health insurance can continue to be enforced. By scheduling the case after Election Day, the court will prevent the argument, likely to be conducted by telephone conference call, from becoming fodder for campaign ads.

I hope Trump sends Roberts a thank you note for this bit of scheduling. Roberts has earned it. It would serve the country to have the positions of the GOP and White House demanding the ACA be struck down, root and branch, on the record before the election, but it wouldn't serve the interests of the GOP. That is of course why Roberts delayed it.

I hope Trump sends Roberts a thank you note for this bit of scheduling. Roberts has earned it. Two years ago on the campaign trail the GOP candidates all pretended they wanted to protect people with pre-existing conditions, despite their hundreds of votes to bring back pre-existing conditions, and despite their ongoing lawsuit to bring them back.

No doubt we'll see more of the same now. They don't dare publicly own their position.
