Supreme Court Strikes Down Texas Abortion Law

Just two weeks after Scalia passed away the Texas law case was heard and there was a 4 / 4 vote, which meant the Texas law enacted 3 years ago, which forced "undue burden" on women - would remain to be subject to the 5th Circuit Appeals Court ruling which is Super Pro-Life - until reheard again.

And by the way, 13 other states tried to use loopholes to enact laws very similar to the Texas law. They too will be licking their calves over.

So now women won't be held hostage by a ruling by the Appeals Court that was Unconstitutional in the first place.

Even if Scalia was participating in hearing this Texas case...the outcome would have been 5/4, so Roe v Wade would have survived once again.

This is good news for women's health.

Apparently Justice Thomas was the only Justice with strong dissent.
Both Justice Alito and Chief Justice Roberts wanted to send the laws back to the lower courts for more evidence.

The 5th Circuit Appeals Court...is hardcore pro-life. It's already stated on two occasions that the Texas law poses no undue burden on women and won't sway from that. In other words, there's no evidence that will be valid to this Appeals Court.

Sounds like Texas was purposely trying to keep Key data from the Public.

A state employee with knowledge of the annual data Texas collects on abortion spoke to NBC News and is accusing state officials overseeing the Department of Health Services of intentionally blocking the information and instructing staff members to mislead people who ask for it.
Because fact-finding traditionally ends after such a case goes to trial, long before it reaches the Supreme Court, the justices may or may not have considered it. But in the court of public opinion, the data could potentially undermine Texas' official argument that its requirements pose no particular burden on women.

The Texas Legislators who passed the law "wouldn't hear evidence that their claims were false". They kicked people out of the hearings just prior to passing the law.

About a month after the Texas Legislature passed the law - there were like two or three EXTREMIST Republican members who FESSED UP that passing the law had nothing to do with the health and welfare of women. It was to stop abortion, period. There's videos of them saying such, at least here in Texas, which the videos are owned by an Austin TV station.

You had it right. FABRICATED. That's what they did when the Legislature passed the law. They made up their own nonsense about how the current system placed women's health in jeopardy...but had no evidence to prove it.

That alone should have been enough to strike down the law. Fortunately, there are some sane people in Texas, including on your Supreme Court.
 
Abortion should be free and on demand to anyone who wants one. Population/poverty control. Less single mothers that way!

Your comment - when you think about it. It has more potential to reduce the size of government over the long-term.

A lot of anti-abortion supporters will say that raising an unwanted child, paid for by the government (about 300k per child), is better than allowing abortion at all. Oh wait, these same anti-abortion supporters want social services, that substantially help children, reduced or eliminated. Almost forgot that.

However, anti-abortion folks also say that taxpayers doling out the money for abortion (about 1000.00 to 1500.00) is taboo. Go figure?

Anti-abortion supporters believe women who have unwanted pregnancies need to be punished for 18 plus years. In other words, don't have sex unless it's for procreation.
