Another day, another Biden failure.


The U.S. Supreme Court issued two highly anticipated rulings on Thursday, temporarily blocking a Biden administration COVID-19 vaccine mandate for large employers but allowing a separate rule applying only to health care workers at facilities receiving federal funding.
The high court settled the matter concerning large employers in a 6-3 decision to block the rule that would have been issued by the Occupational Safety and Health Administration, with the three liberal justices dissenting.

I mean didn't he try to do just that by doing the end around with OSHA, instead of just passing a law that his advisors had already told him would be unconstitutional?

The only issue that the SCOTUS was supposed to decide was whether the Executive Branch had the authority to impose mandates for workers. How can they have decided that it was ok to impose mandates for health care workers but not other workers? This Supreme Court is indeed legislating from the bench -- as if they if they had the right to decide on the whether they liked the policy, not whether it was constitutional or not.

The SCOTUS isn't supposed to decide whether a law or rule is a good idea. That's the responsibility of Congress and the President to debate. The SCOTUS only has the charge to decide whether the constitution prohibits the law or rule.

They ruled the other way for the health care workers because that mandate was premised upon the receipt of federal funding. It is long-established precedent that the federal government can attach strings to the money it doles out.

How can the executive branch unilaterally decide who gets federal funds? That's the role of legislation.

Nope, since it was only some private workers and never presented to congress. It was also based on the completely false idea that ‘fully vaccinated’ workers can’t spread COVID-19 in the workplace, thus need not be masked or tested.

That was a bit of a stretch, but based on the idea that they worked in federally funded medical care institutions. It also did not include moronic masking exemptions for ‘fully vaccinated’ workers, pretending that they could not spread COVID-19.

It is the left that is seeking to prolong the pandemic. They are hoping to benefit from it in the 2022 midterms as they did in the 2020 election.
 
Since more Democrats than Republicans are taking shots for Covid, the Dems might be in a much better place than they thought in 2024.
