Special counsel Jack Smith said Monday that he is dropping the federal election subversion case against President-elect Donald Trump, seeking the case’s dismissal in a court filing with the judge.
Trump has said he would fire Smith once he retook the office, shattering previous norms around special counsel investigations.
“The (Justice) Department’s position is that the Constitution requires that this case be dismissed before the defendant is inaugurated,” Smith wrote in a six-page filing. “This outcome is not based on the merits or strength of the case against the defendant.”

The main problem will be these people know excellent lawyers so can use the same delay tactics that Trump uses and they only have to delay for 4 years because I have a feeling once Trump leaves office these revenge charges will go away.

It was dismissed without prejudice and Chutkan made a point that the status of president is temporary in nature. Also, Trump's legal team did not oppose the without prejudice status, which means that the avenue for appeals is closed.I hope they pick this up again in 4 years.
Chutkan just issued a finding of no prosecutorial misconduct, so that just got a lot harder to do if that is your goal. Trump's desire for lawfare has been anticipated and largely dealt with already.I hope Trump sends Jack Smith into a supermax solitary. Its what he deserves.
