"Universal" background checks criminalize behavior that has no adverse effect on society while being wildly ignored by criminals. Even noted gun control researcher Garen Wintemute found that UBC laws had no effect on homicides and suicides.

it is not outlandish to those who understand the topic. criminalizing a failure to do a background check is stupid because the government doesn't bother punishing those who fail one- gun banners want to create all sorts of Malum Prohibitum offenses to target gun owners

If two non-prohibited persons exchange firearms without a background check under a UBC law, they've committed a crime. This crime is not a risk to society.

You should go read HR.8 before engaging on this subject further, so that you actually understand the proposed law.

In HR.8, the current "universal" background check bill, the law states:
Give a gun to your brother, no background check needed.
Loan a gun to your brother, no background check needed.
Sell a gun to your bother, it's a crime if there isn't a background check.


Under HR.8, the current "universal" background check bill, the law state that as long as someone has a hunting or fishing licenses, and the loaner has no reason to suspect that the loanee is a prohibited person, the loaner can loan any firearm to that loanee without a background check for any length of time.

In the Colorado version of the UBC, a gun owner can lend a firearm to anyone that they don't believe is a prohibited person for any lawful purpose for up to three days without a background check, and they don't even have to know the person at all for it to be a legal transaction.

Loaning a shotgun to a close single mom friend whose violent ex-husband gets out of jail at the end of the week.
Loaning a shotgun to a neighbor to shoot some skeet at the local range.

In Ohio, if you have a CCW, that's used in place of a background check.
