I would love it if human civilization was cultured and economically efficient enough to realistically plan for future encounters with other sapient beings in the galaxy, but any extraterrestrial we are likely to meet in the next couple centuries will probably be far beyond the application of our laws.

If the galaxy has given rise to violent beings that swarm like locusts and exist for no other reason than war (it is hard to imagine interstellar wars for any other reason than because some organisms by nature exist to fight regardless of how technologically advanced or prosperous they are), we would probably have to create a different set of laws.

Yes, especially if the extraterrestrials were microbial and extremely virulent to humans. These ET microbes should be strictly forbidden to use themselves as weapons.

An alien race with the capability to project military power across the galaxy or universe would be far outside the reach of our laws. They would laugh our primitive nuclear and chemical weapons as they could unleash weapons of unimaginable devastation. Anti-matter bomb anyone? They would be so intelligent a basic thought to one of them would be impossible for any of us to comprehend. I think it's funny how in the movies aliens show up and then something cheesy kills them like our microbial life. I think if aliens had plans to attack us they would think of such basic things.
 
Only if we are the superior civilization so we can enforce that treaty... after we nuke the living crap out of them.
