Sen. Hawley warns of Biden SCOTUS pick's 'long record' of letting child porn offenders 'off the hook'

Republican Sen. Josh Hawley posted a lengthy Twitter thread Wednesday containing several examples that he says demonstrates an "alarming" pattern of lenient treatment of sex offenders who prey on children from Biden Supreme Court nominee Judge Ketanji Brown Jackson.

"Judge Jackson has a pattern of letting child porn offenders off the hook for their appalling crimes, both as a judge and as a policymaker," the Missouri Republican tweeted Wednesday. "She’s been advocating for it since law school. This goes beyond ‘soft on crime.’ I’m concerned that this a record that endangers our children."

Judge Ketanji Brown Jackson speaks after President Biden announced Jackson as his nominee to the Supreme Court in the Cross Hall of the White House, Friday, Feb. 25, 2022, in Washington.

This almost makes me forget that the Republican Party is perfectly cool with one of their own, Matt Goetz, being an actual child sex trafficker.

An actual child sex trafficker?
You wouldn't happen to have a citation there, you know.
Not that I'm calling in your defense of letting pedophiles off the hook into question or anything, but that would usually be one of those claims that requires some form of proof.

VySky, did you verify that all of Hawley's assertions are indeed true? Or are you just taking his word for it?

18 USC §3553 (b) (2) (Italicized sections added):

(2) Child crimes and sexual offenses.—

(A) Sentencing.—In sentencing a defendant convicted of an offense under section 1201 (kidnapping) involving a minor victim, an offense under section 1591 (peonage, slavery, or trafficking in persons) , or an offense under chapter 71 (obscenity), 109A (sexual abuse), 110 (sexual exploitation or other abuse of children), or 117 (transportation for illegal sexual activity and related crimes), the court shall impose a sentence of the kind, and within the range, referred to in subsection (a)(4) unless—

(i) the court finds that there exists an aggravating circumstance of a kind, or to a degree, not adequately taken into consideration by the Sentencing Commission in formulating the guidelines that should result in a sentence greater than that described;

(ii) the court finds that there exists a mitigating circumstance of a kind or to a degree, that—

(I) has been affirmatively and specifically identified as a permissible ground of downward departure in the sentencing guidelines or policy statements issued under section 994(a) of title 28, taking account of any amendments to such sentencing guidelines or policy statements by Congress;
(II) has not been taken into consideration by the Sentencing Commission in formulating the guidelines; and
(III) should result in a sentence different from that described; or

(iii) the court finds, on motion of the Government, that the defendant has provided substantial assistance in the investigation or prosecution of another person who has committed an offense and that this assistance established a mitigating circumstance of a kind, or to a degree, not adequately taken into consideration by the Sentencing Commission in formulating the guidelines that should result in a sentence lower than that described.

In determining whether a circumstance was adequately taken into consideration, the court shall consider only the sentencing guidelines, policy statements, and official commentary of the Sentencing Commission, together with any amendments thereto by act of Congress. In the absence of an applicable sentencing guideline, the court shall impose an appropriate sentence, having due regard for the purposes set forth in subsection (a)(2). In the absence of an applicable sentencing guideline in the case of an offense other than a petty offense, the court shall also have due regard for the relationship of the sentence imposed to sentences prescribed by guidelines applicable to similar offenses and offenders, and to the applicable policy statements of the Sentencing Commission, together with any amendments to such guidelines or policy statements by act of Congress.

---

If Judge Jackson has strayed from the sentencing guidelines in specific cases, I'd be highly surprised if she didn't so for mitigating circumstances, such as those laid out above, and will be prepared - as a former Vice Chair of the US Sentencing Commission - to defend her every decision - sentencing or otherwise - made from the bench. Maybe Senator Hawley would be willing to throw the book at a contrite mentally deficient first-time offender who has offered substantial cooperation to the authorities... but the vast majority of Judges will not.

The rule with Hawley is the same with most of the deplorables in congress, assume they are lying unless there is independent proof.

"The Josh Hawley criticism of Judge Jackson is ridiculous. His criticisms rest on a unanimous report by the Commission & the fact KBJ has sentenced defendants in non-production porn cases to sentences below the Guidelines. Both points are silly.
https://twitter.com/RachelBarkow

Less than 30% of all non-production cases get a Guidelines sentence because just about federal judge realizes these Guidelines are too severe. So KBJ is doing what most of the federal bench does. https://ussc.gov/sites/default/files/pdf/research-and-publications/research-publications/2021/20210629_Non-Production-CP.pdf…

And that report was a unanimous one, joined by two Republicans. One of them is Judge Dabney Friedrich, who Josh Hawley voted to confirm without raising a word about the fact she also joined the report."

Ouch.

It's now pretty clear why OP won't actually answer to Hawley's allegations, and is instead already derailing his own thread with deflections to Russia and the Hunter laptop business.

Yes, proof. Something that is usually supplied in the case of most claims or allegations.

It's interesting that you only requested proof from @Cardinal but not from @VySky 's OP's allegations.

It's almost as thought it's not really about "proof".

If true Sen Hawley probably benefited from this tendency since I have seen nothing yet that is low enough for Hawley not to have tried it at least once.

It's almost as though you lack reading comprehension.
Who's post was being responded to and what claims were being made within said post.

As the OP's story sits, I can easily see what kind of information they're sitting on.
Cardinal's claim on the other hand was not something that I could just as easily google, because as far as I can tell. The man does not possess such an arrest record, nor was he charged and convicted of such a crime. Which was why I asked as such.

Does that help you understand?
