Sen. Rand Paul tried to convince America that Obama is committing a crime, but instead he fell flat on his face and showed the world that he doesn’t know what the president actually does.

Sen. Paul was trying to build the case that it is illegal for President Obama to delay parts of the ACA when his intellectual choo-choo went off the tracks. Paul said, “The way our country works is that legislation is written by Congress, passed by your representatives, the president doesn’t get to write legislation, and it’s illegal and unconstitutional for him to change legislation himself.”
Rand Paul doesn’t understand what the role of the president is. The Executive Branch is in charge of implementing the law. The whole problem with Sen. Paul’s argument is that he referred to the ACA as legislation, but it isn’t legislation. The Affordable Care Act is the law, and Executive Branch has been constitutionally given the power to implement the law. These sorts of delays in implementation are common. Both Democratic and Republican administrations have used them.The Supreme Court has found that it is constitutional for the Executive Branch to delay the implementation of a law, “As held by former Chief Justice William Rehnquist in a leading case on this subject, Heckler v. Chaney, courts must respect an agency’s presumptively superior grasp of “the many variables involved in the proper ordering of its priorities.” Chief Justice Rehnquist suggested that courts could lose their deference to Executive Branch judgment if an “agency has consciously and expressly adopted a general policy that is so extreme as to amount to an abdication of its statutory responsibilities.” The Obama Administration has not and is not about to abdicate its responsibility to implement the statute on whose success his historical legacy will most centrally depend.”

LOL - apparently the website doesn't want people to read their stuff seeing as how they smother their readers with popups and poorly rolling script. Maybe later it'll work for me, but obviously it's all political bias about political bias.

I never claimed it was not biased. Did you see what section you are in? But saying that it does not hold the fact that Ran Paul's position is not constitutionally and legally correct.

Judging by his past behavior he'll probably collect some facts and rejoin the reality-based world eventually.

He does get a little out of the mainstream from time to time, but he isn't a total loser.

Rand Paul is not incorrect in his opinion. Obama is clearly picking and choosing portions of laws (legislation that has passed congress and been signed into law) that he likes and either delaying or simply not (or very selectively) enforcing the parts that he does not like. Simply because other presidents have done "similar" things does not make it right. From "dreamy" enforcement of immigration law, targetted enforcement of tax law and now announcing plans to ignore mandatory sentencing for violations of federal (drug?) laws, possibly making that retroactive. Political expediency should not give the executive power to ignore enforcement of the law. The president has the power to pardon convicted criminals but not to order judges (or federal LEOs) not to enforce the law as written.

Such things happen from time to time, if you were to ask Paul for clarification, you don't believe he has a grasp of what the president does? Did you see this week how the president doesn't know the difference between the east coast and the gulf coast?
 
The administration is seeking to delay implementation of the law because they know that once it goes into effect it will look like the piece of **** that it is and it will cost them votes and support in the 2014 elections. That is a far cry from refusal to enact legislation (legislation the president as executive SIGNED) based on "the clause authorizes a president even to decline enforcement of a statute altogether, if in good faith he determines it to be in violation of the Constitution."

I would love to have someone here tell us exactly what President Obama does other than take lavish vacations, play a lot of golf, and campaigns ever day for a job he already has. The economic results today say that he is AWL when it comes to handling of the economy and showing leadership skills unless you believe having 47 plus million on food stamps, 22 million unemployed/under employed/discouraged workers, adding over 6.2 trillion to the debt, a disastrous foreign policy costing us respect around the world, stagnant economic growth is good policy. Paul doesn't know what the President does nor do many of his supporters.

Implementation of whole laws have been called constitutional, not picking apart the pieces that make you look bad.
 
Yeah. The president's obviously a little challenged geographically. Maybe more than just a little.

Nope. The Executive branch can dely parts of a law as so long as the whole law is implemented at one point and time.
