Im more concerned with the people who are watching and "liking" a video of a rape.

I have not watched the video, so is it obviously a rape video, or could it be confused for just sex, or rough sex?

I would judge that young woman as, at best, an accessory to the rape.

Lonina’s attorney Sam Shamansky argued in court. “She was swept up by the gravity of the situation and as she immediately told the police, she was filming in order to preserve, not to embarrass or to shame or to titillate anybody.”

Sorry, but that's not how Periscope works. She can set the broadcast to be preserved for 24 hours, but then it disappears. The only way she could "preserve" the event is for her to record the stream separately from the broadcast. I see no mention that's what she did.

It would have been easier to preserve the event if she just used her phone's camera to record a video of the act.

Couldn't they be prosecuted for watching child porn (being that the victim was 17)?

I have not watched the video, so is it obviously a rape video, or could it be confused for just sex, or rough sex?

Since the victim was 17, I figure the video has been pulled, given that it would be illegal to watch or possess it.

I would think that the people watching a livestream would have to reasonably have known that a participant (unwilling is still a participant) of sexual conduct was under the age of 18.

Since there is often not much visual noticeable difference between a 17 and 18 year old.... plus the difficulty of tracking down IP addresses and then finding out who on that IP was the actual person watching..... I'd say .... "No".

Thats just nuts, theres videos of assaults and crimes all over the net and the videographers just watch it happen

Did she call 911 before she started taking video. If she called 911 FIRST then began to video it. Then she would have an out that she was trying to preserve evidence

The article doesn't say that she called 911. It says that people watching her broadcast called for help.

I know that, I was saying "IF" she had called 911 first then she had an out that she was recording it for evidence. Calling 911 first would have at least be an attempt to help her.

Its disgusting some of the videos posted even on the daily news where you hear the recorder laughing at someone being beaten to the extent it could possibly be fatal. Where did that mentality come from. We would jump right in and save the person being set on. Its not the cellphones its the person recording and laughing at someone elses pain.
