President Trump pledged to mount a legal challenge in Pennsylvania before all votes were counted

President Trump has made it clear that he will not concede even if he appears to be losing — if, for example, Florida tilts to Joseph R. Biden Jr., the Democratic presidential nominee.

Speaking to reporters Sunday evening, Mr. Trump vowed to mount a legal challenge in Pennsylvania even before all votes were counted, which could take days as mail-in ballots continue to arrive after the election.

“We’re going to go in the night of, as soon as that election is over, we’re going in with our lawyers,” Mr. Trump said.

The president, who has spent months undermining public confidence in the election system, said that he would also probably mount legal challenges in other states, including Nevada, because the governor there is a Democrat.

Mr. Trump repeated his desire that all the votes be counted on Election Day.

“I don’t think it is fair that we have to wait a long period of time,” he said.

In fact, even though races may be unofficially called on election night when one candidate appears to have an insurmountable lead, no state ever reports final results on election night, and no state is legally expected to. If states were to stop counting after Nov. 3, it would be an extraordinary subversion of the electoral process and would disenfranchise millions of voters who cast valid, on-time ballots.

This is how democracy is lost and an autocracy is formed, where the facade of democracy, elections, exist but the leader in power uses the force of the government that he controls, to stay in power.

The question is: besides voting him out, what can we do about it, when he spent the last four years putting his lackeys on the federal courts?

There are arguments being made, that if your ballot isn’t counted by Election Night, that it shouldn’t be counted at all, and that counting them amounts to stealing the election. Do not spread or give any credence to these arguments. It has never and will never be the case that all ballots are counted by Election Night. It is literally impossible to count 160 million ballots in that amount of time.

You do not lose the right to have your vote counted just because Trump wants to declare victory on Election Night. Whatever your political affiliation. Period. This has to be our red line, which if crossed, must be challenged. Otherwise, we don’t have a democracy or a republic, just an autocracy. I hope you feel the same.

Of course he will, even though there is absolutely no legal obligation whatsoever for states to announce the victor on Election day.

trump is like that guy who rents an apartment from you. He doesn't pay rent so you evict him. trump then uses every trick in the book so that you can't kick him out, and he lives in your apartment rent free for a year.

trump has NEVER handled defeat gracefully. Ever. Worse, he incites the worst of his followers to violence to try to keep him in power.

Just Trump being Trump. Using our legal system as a weapon.

There is a young and naive Cardinal buried inside me that still holds on to the belief that a legal argument to stop a vote count (he clearly believes this would be an analogue to the 2000 SC decision) would be thrown out even by a partisan right wing court.

Shouldn't he be concentrating on the giant SDNY/Manhattan DA hammer that's about to come down on his head?

Maybe that is what he's concentrating on.

And the Trump supporters will defend his words as always. They're fine with him cheating and stealing the election.

I have that naive view too -- that the legal system won't bend to a blatant baseless and spurious legal challenge -- but the other part of me sees partisans being elevated to the federal courts.
