U.S. District Judge William Stickman IV, who was appointed by President Trump, sided with plaintiffs that included hair salons, drive-in movie theaters, a farmer's market vendor, a horse trainer and several Republican officeholders in their lawsuit against Wolf, a Democrat, and his health secretary.

**snip**

The governor's efforts to slow the spread of the coronavirus "were undertaken with the good intention of addressing a public health emergency," Stickman wrote. "But even in an emergency, the authority of government is not unfettered."

A-****ing-men.

This is why judges matter.

Makes Biden's insistence he'd lock us ALL down if elected even funnier.

Meh. This is one of those self-correcting problems.

What problem? I mean, I know why I had a problem with it, but there isn’t a lockdown restriction I’ve heard of which hasn’t been embraced by the left.

People too stupid to take sensible precautions are a self-correcting problem. Off they go, the world will not miss them.

Fortunately it’s a small fraction that die from it.

Governor Wolf came up with a system where companies in certain classifications could open and then had a very opaque process of requesting waivers. When the list became public, it caused quite a stir.

As for hair salons, beauticians have the most medical training of any licensed professional in the state outside actual healthcare workers. This particular ruling is not surprising.

And there hasn't been a chance to spread the virus the right hasnt embraced.

Stayed within days then overturned

This makes what I've been saying for the last year and a half glaringly true: Even if Democrats take over the Senate and the WH and keep the House, their first act has to be to pack the courts. Literally every other agenda will be shot down if they don't do that first: investigations, voting rights act, climate change reduction policies, tax policy...you name it. If Democrats so much as try setting a school lunch policy that'll be shot down in the courts too.

Personally, I think the entirety of the first term should be about packing the courts, then passing HR1 and a healthcare legislation. In the second term we can start attack global warming and economic disparity issues.

McConnell's entire agenda has been to replace Congress and state rights with the Federal court system, and that's exactly what he's done.

And there hasn't been a chance to spread the virus the right hasnt embraced.

Really? Is it the right that’s supporting protesters not social distancing and yelling in the faces of others (like cops, diners in a restaurant, a US Senator) without masks?

True, only 200,000 so far, but I am sure we will hit 300,000 before Christmas and maybe a Half a Million after that. Gonna just Fade Away....

The judge is basing his ruling under the First Amendment right for freedom of assembly. The judge is making quite a stretch in his interpretation in terms of it's applicability in this case. It's a weak argument and almost certain to be quickly overturned on appeal

It’s scary to me how many of you actually object to lifting government restrictions.

Why would it be scary to empower the government during a public health emergency? If we had 1M cases of ebola would you be making the same argument?

How about "abuse of power"?

You didn’t answer the second question. If we had 1M cases of Ebola would you support the government having the power to limit activity?

And you are comparing how many people to trump's rally in nevada? Really?

It’s scary to me that there is a judge out there who thinks he has the power to overturn Supreme Court decisions. This issue was litigated in the Supreme Court ages ago and its decision stands regardless of what this judge says.

1 million cases or 1 million deaths? What you’re really asking is if I can envision a set of circumstances in which I would support lockdown measures, and sure, I can, but there needs to be a balancing of interests. Shutting down the economy is harmful so it should be taken seriously and be a last resort.
